ORDINANCE NO. 33-80 BY: Gallagher, Graham, McBride, Salmon, Wendling, Brown, Chinnock AN E}~RGENCY ORDINANCE to provide for the issuance of notes in anticipation of the levy of special assessments and in anticipation of the issuance of bonds to pay the property owners' .portion and the City's portion of the cost of improving certain streets in the City of Lakewood, Ohio, by grading and replacement of the base, resurfacing with asphaltic concrete including the necessary r~placement and resetting of castings together with' the necessary appurtenances thereto. WHEREAS, the Council of the City of Lakewood has heretofore by pro- per legislation determined to proceed with the improvement of the streets hereinafter designated by the necessary grading and replacement of the base, resurfacing with asphaltic concrete including the necessary replacement and resetting of castings together with necessary appurtenances thereto; and WHEREAS, this Council by two-thirds vote of the members elected thereto determines that this ordinance is an emergency measure which is necessary for the immediate issuance and sale of the notes herein authorized to enable the City to enter into ~onstruction contracts to provide the im- provements described herein which are urgently required to eliminate exist- ing hazards to vehicular traffic using the streets of this City; NOW, THEREFORE, BE IT ORDAINED by the City of Lakewood, Cuyahoga County, State of Ohio, three-fourths of all members elected thereto concur- ring: Section 1. Thf~ it is hereby declared necessary to issue bonds of the City of Lakewood in the principal amount of $360,000 for the'purpose of paying-the property owners' portion, in anticipation of the collection of special assessments, and the City's portion of the cost of improving: Waterbury Avenue from Madison Avenue to Bramley Avenue Wyandotte Avenue from Madison Avenue to Lakewood Heights Boulevard Woodward Avenue from South Marginal Road to Fischer Road Wagar Avenue from Detroit Avenue to Madison Avenue Victoria Avenue from Madison Avenue to Htlliard Road Bunts Road from Detroit Avenue to the Norfolk and Western-Railroad ~' Thrush Street f~om Halstead Avenue to Quail Street and from Lark Street to Magee Avenue Delaware Avenue from Lakeland Avenue to BrowmRoad Atkins Avenue from South Marginal Road to Fischer Road Atkins Avenue from Hilliard Road to North Marginal Road Whippoorwill Avenue from Clifton Boulevard. to Lake Aven~e Clifton Place from its northerly intersection with Detroit Avenue to its southerly terminus Adeline Avenue from its northerly intersection with Delaware Avenue to its southerly intersection with ~akewood Heights Boulevard Hilda Avenue from its northerly intersection with Delaware Avenue to its southerly intersection with Lakewood Heights Boulevard, by the necessary grading and replacement of the base, resu~facing with as- phaltic concrete including the necessary replacement and resetting of cast- ings together with the necessary appurtenances thereto, in the manner provided in Resolutions Nos.'5362 adopted January 15, 1979 as amended by Resolution No. 5388, adopted April 3, 1979 and Resolution No. 5427, adopted December 3, 1979, and amended by Resolution No. 5467 adopted May 5, 1980. Of said amount the City's portion is $225,239.82 and the property owners' portion is $134,760.18.
