ORDINANCE NO. 37-80 BY: <br /> <br />Gallagher, Graham, McBride, Salmon, <br />Wendling, Brown, Chinnock <br /> <br />AN EMERGENCY ORDINANCE authorizing the Director of Public Works to <br />charge a fee for tennis playing during specified hours on the tennis <br />courts located in Lakewood Park and repealing Ordinance No. 25-70, <br />adopted April 20, 1~970, and all other ordinances or parts of ordinances <br />inconsistent herewith. <br />WHEREAS, the demand for the use of municipal tennis courts is such <br />that regulation thereof is mandatory, and, <br />WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Director of Public Works be and he is hereby auth- <br /> orized to charge a fee for tennis playing on the Lakewood Park tennis <br /> courts between the hours of 5 p.m. and ll p.m. on weekdays and between <br /> the hours of 12 noon to ll p.m. on Saturdays, Sundays and holidays, as <br /> follows: <br /> $25.00 for a pass issued to a City of Lakewood resident, which <br /> entitles such resident to use said courts during the tennis <br /> season of the year for which such pass is issued. <br /> <br /> $40.00 for a pass issued to a non-resident of the City of <br /> Lakewood, which pass entitles such non-resident to use said courts <br /> during the tennis season of the year for which such pass is <br /> issued~ <br /> The right of pass holders to the use of said courts shall be <br /> subject to availability thereof for play. <br /> <br /> $1.00 per hour shall be charged all persons not having a pass, <br /> using said courts during the hours and on the days mentioned in <br /> paragraph one of this section. <br /> The Director of Public Works is further authorized to charge a fee <br /> of $30.00 for the instructional course consisting of six (6) <br /> sessions (2 sessions per week for three consecutive specified <br /> weeks) of one hour each. <br /> The Director of Public Works is further authorized to charge a <br /> fee of $15,00 per person for group instructional courses consisting <br /> of six (6) sessions of one hour each. <br /> The tennis season shall extend from April to October of each year, <br /> the specific dates for opening and closing of such season shall <br /> be fixed by the Director of Public Works. <br /> <br /> Section 2. That this ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided it <br /> receives the affirmative vote of two-thirds of all members elected to <br /> Council, it shall take effect and be in force immediately upon its <br /> adoption and approval by the Mayor, and at such time, Ordinance No. 25-70 <br /> and all other ordinances or parts of ordinances inconsistent herewith <br /> shall be and are hereby repealed. ~ ~?_~ <br /> <br /> <br />
