ORDINANCE NO. 37-80 BY: Gallagher, Graham, McBride, Salmon, Wendling, Brown, Chinnock AN EMERGENCY ORDINANCE authorizing the Director of Public Works to charge a fee for tennis playing during specified hours on the tennis courts located in Lakewood Park and repealing Ordinance No. 25-70, adopted April 20, 1~970, and all other ordinances or parts of ordinances inconsistent herewith. WHEREAS, the demand for the use of municipal tennis courts is such that regulation thereof is mandatory, and, WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Public Works be and he is hereby auth- orized to charge a fee for tennis playing on the Lakewood Park tennis courts between the hours of 5 p.m. and ll p.m. on weekdays and between the hours of 12 noon to ll p.m. on Saturdays, Sundays and holidays, as follows: $25.00 for a pass issued to a City of Lakewood resident, which entitles such resident to use said courts during the tennis season of the year for which such pass is issued. $40.00 for a pass issued to a non-resident of the City of Lakewood, which pass entitles such non-resident to use said courts during the tennis season of the year for which such pass is issued~ The right of pass holders to the use of said courts shall be subject to availability thereof for play. $1.00 per hour shall be charged all persons not having a pass, using said courts during the hours and on the days mentioned in paragraph one of this section. The Director of Public Works is further authorized to charge a fee of $30.00 for the instructional course consisting of six (6) sessions (2 sessions per week for three consecutive specified weeks) of one hour each. The Director of Public Works is further authorized to charge a fee of $15,00 per person for group instructional courses consisting of six (6) sessions of one hour each. The tennis season shall extend from April to October of each year, the specific dates for opening and closing of such season shall be fixed by the Director of Public Works. Section 2. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor, and at such time, Ordinance No. 25-70 and all other ordinances or parts of ordinances inconsistent herewith shall be and are hereby repealed. ~ ~?_~
