ORDTNANC~ NO. 40-80 <br /> <br />B¥:Gallagher, Graham, McBride, <br />Salmon, Wendling, Brown, <br /> <br /> AN ORDINANCE to supplement Chapter 521 of the General Offenses <br />Code of the Codified Ordinances of the City of Lakewood enacting new Section <br />521.15 relating to newspaper drop off deliveries. <br /> <br /> WHEt{EAS, numerous complaints have been received regarding wrappers, <br />wires, strings and extra newspaper advertising sections being blown around <br />neighborhoods as a result of said debris being left by newspaper carriers at <br />various street corners, and <br /> <br /> WHEREAS, not only is the scattering of such debris unsightly, but <br />problems have arisen where said debris has caused blockages in catchbasins <br />throughout the City, and <br /> <br /> WHEREAS, this CoUncil determines that the aforementioned problems <br />can be eliminated by requiring newspapers to be delivered to residential <br />property; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br />OHIO: <br /> <br /> Section 1. That Chapter 521 of the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood shall be and the same is hereby <br />supplemented by enacting new Section 521.15 to read as follows: <br /> <br />521,15 NEWSPAPER DROP OFF DELIVERIES. <br /> <br />(a) No person shall'place or deposit newspapers in <br /> bundles, or otherwise, on the sidewalk or any <br /> public right of way in the City as a delivery <br /> drop off of such newspapers. Delivery of <br /> newspapers to a location other than the residential <br /> property occupied by a consignee of such papers <br /> shall constitute prima facie evidence of a violation <br /> of this section; provided, however, that this section shall <br /> not be construed to prohibit the delivery of <br /> newspapers to any residential or commercial <br /> property where the occupant or owner has con- <br /> sented thereto. <br /> <br />(b) ~oever violates this section is guilty of a <br /> minor misdemeanor. <br /> <br /> Section 2. That it is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations <br />of this Council and of any of its comntittees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. <br />of August, 1980. <br /> <br />Adopted:~ <br /> <br />Approve d ~-~ <br /> <br />That this ordinance shall take effect as of the 1st day <br /> <br />Mayor <br /> <br /> <br />
