ORDINANCE NO. 51-80 <br /> <br />BY: McBride, Salmon, Wendling, Brown, <br /> Chinnock, Gallagher, Graham, <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor to enter <br />into a parking lot agreement with the Lakewood Town Center Development Company. <br /> <br /> WHEREAS, the City is the owner in fee simple of real property (the <br />parking area) described in Exhibit A of the parking lot agreement attached <br />hereto and made a part hereof by reference and; <br /> <br /> WHEREAS, the Community Development Corporation intends to lease to <br /> the Lakewood Town Center Development Company certain real property (the premises) <br /> described in Exhibit B of the parking lot agreement attached hereto and made a <br />· part hereof by reference, and; <br /> <br /> WHEREAS, the parking area and premises are adjoining and contiguous <br />to each other, and; <br /> <br /> WHEREAS, the parties desire to enter into this agreement for the <br />maintenance and use of the parking area, and <br /> <br /> WHEREAS, the parking area shall be used solely as a facility for off- <br />street parking of motor vehicles and shall be open to use by members of the <br />general public without charge, and <br /> <br /> WHEREAS, the parking lot agreement is intended to result in the park~ ...... <br />lng area being available for the use by residents of the City and others free of <br />charge, to provide for useable ingress and egress for the parking area, to <br />eliminate, except for 'snow plowing and removal, the obligation and expense to <br />the City of maintaining and repairing the parking area, to provide to the City <br />from the parking area and the development which it will serve, additional <br />revenues to be used in the City's operation, and to permit the City to continue <br />to enforce its ordinance against over-time parking and other violations, and; -' <br /> <br /> WHEREAS', this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public peace, property, health and safety <br />and for the further reason that the immediate authorization of the actions herein <br />to expedite the development and revitalization of the City is necessary in.order <br />to create and preserve jobs and employment opportunities and to prevent the <br />spread of blighted, deteriorated or deteriorating conditions; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to enter into a parking lot agreement with the Lakewood Town Center Company. Said <br />agreement is to be substantially in.~the form as set forth'on Exhibit A attached <br />hereto and made a part hereof as if fUlly rewritten herein. <br /> <br /> Section 2. That it is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were adopted <br />in an open meeting of this CoUncil, and at such deliberations of this Council and <br />of any committees that resulted in such formal action, were in open meetings tO <br />the public, in compliance with all legal requirements including Section 121.22 of <br />the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br /> <br /> <br />
