ORDINANCE NO. 62-80 <br /> <br />BY: Gallagher, Graham, McBride, Salmon, <br /> Brown, Chinnock <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor to enter <br />into an option agreement with John and Frances DeFrasia to purchase real <br />property located at 11800 Detroit Avenue, Lakewood, Ohio, permanent, parcel <br />nos. 312-33-14 and 312-33-15. <br /> <br /> WHEREAS, this Council authorized the City to request a Section 108 <br />Loan for the Gateway development and the development of the eastern portion <br />of Lakewood, and <br /> <br /> WHEREAS, the acquisition of the property located 11800 Detroit Avenue <br />is essential for said development,' and <br /> <br /> WHEREAS, the owners of said property concede the right of the City <br />to take said property and are willing to grant the City an exclusive option, and <br /> <br /> WHEREAS, the City is desirous of obtaining an option to purchase real <br />estate located at 118OO Detroit Avenue in order to solicit proposals for the <br />development of said property to create and preserve jobs, employment opportunities <br />and to improve the economic welfare of the people of the City of Lakewood for <br />the use or development for industry, commerce, housing, distribution or research <br />and for the further purpose of preventing the spread of blight in the nei~ghbor- <br />hood, and <br /> <br /> WHEREAS, after extensive discussions between the owners of the property <br />and the City of Lakewood, the parties have been unable to agree on a purchase price <br />for said property in the event the City exercises the option; however, the City <br />and the property owners have been able to agree on the method and procedure <br />for establishing the purchase price in the event the City of Lakewood exercises <br />the option which shall expedite the acquisition of the property; and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department and for the immediate preser- <br />vation of the public safety and welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to enter into an option agreement with John and Frances DeFrasia to purchase <br />real property located at 11800 Detroit Avenue, Lakewood, Ohio, permanent parcel <br />nos. 312-33-14 and 312-33-15. Said option agreement to be substantially in <br />the form as set forth in Exhibit A attached hereto and made a part hereof as <br />if fully rewritten herein. <br /> <br /> Section 2. That the Director of Finance be and he is hereby authorized <br />and directed to pay to John and Frances DeFrasia the sum of one dollar ($1.00) <br />in consideration of the grant of the exclusive option to the City of /akewood. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any committees that resulted in such formal action were in meetings open <br />to the public, in compliance with all legal requirements including Section 121.22 <br />of the Ohio Revised Code. <br /> <br /> <br />
