ORDINANCE NO. 62-80 BY: Gallagher, Graham, McBride, Salmon, Brown, Chinnock AN EMERGENCY ORDINANCE authorizing and directing the Mayor to enter into an option agreement with John and Frances DeFrasia to purchase real property located at 11800 Detroit Avenue, Lakewood, Ohio, permanent, parcel nos. 312-33-14 and 312-33-15. WHEREAS, this Council authorized the City to request a Section 108 Loan for the Gateway development and the development of the eastern portion of Lakewood, and WHEREAS, the acquisition of the property located 11800 Detroit Avenue is essential for said development,' and WHEREAS, the owners of said property concede the right of the City to take said property and are willing to grant the City an exclusive option, and WHEREAS, the City is desirous of obtaining an option to purchase real estate located at 118OO Detroit Avenue in order to solicit proposals for the development of said property to create and preserve jobs, employment opportunities and to improve the economic welfare of the people of the City of Lakewood for the use or development for industry, commerce, housing, distribution or research and for the further purpose of preventing the spread of blight in the nei~ghbor- hood, and WHEREAS, after extensive discussions between the owners of the property and the City of Lakewood, the parties have been unable to agree on a purchase price for said property in the event the City exercises the option; however, the City and the property owners have been able to agree on the method and procedure for establishing the purchase price in the event the City of Lakewood exercises the option which shall expedite the acquisition of the property; and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department and for the immediate preser- vation of the public safety and welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to enter into an option agreement with John and Frances DeFrasia to purchase real property located at 11800 Detroit Avenue, Lakewood, Ohio, permanent parcel nos. 312-33-14 and 312-33-15. Said option agreement to be substantially in the form as set forth in Exhibit A attached hereto and made a part hereof as if fully rewritten herein. Section 2. That the Director of Finance be and he is hereby authorized and directed to pay to John and Frances DeFrasia the sum of one dollar ($1.00) in consideration of the grant of the exclusive option to the City of /akewood. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
