ORDINANCE NO. 72-80 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, Wendlin <br /> <br /> AN ORDINANCE to amend Section 1103.02 of the Zoning Code of the <br />Codified Ordinances of the City of Lakewood by changing and revising the <br />Zoning Map with respect to certain property as hereinafter set forth and <br />described and repealing Ordinance No. 54-79. <br /> <br /> WHEREAS, on July 16, 1979 Council adopted Ordinance No. 54-79 which <br />reclassified and chart§ed the use classification of the municipal parking lot <br />located on Ridgewood Avenue north of Madison Avenue from R3 (two family) to <br />BR (business residential) as part of an overall plan to construct much needed <br />low-cost housing for the elderly in the Madison-Ridgewood area and which use <br />is in keeping with the present use of said parking lot, and <br /> <br /> WHEREAS, the procedures followed with respect to notice to surrounding <br />property owners and in the p~Dlication of the notice of public hearing have given <br />rise tosome question as to the validity of Ordinance No. 54-79, and <br /> <br /> WHEREAS, this Council, while not wishing nor intending to admit to <br />irregularities in the adoption of Ordinance No. 54-79, it does desire to <br />affirm and finalize the rezoning of the aforementioned municipal parking lot <br />so that the aforementioned housing project for the elderly may proceed free <br />and clear from any question as to the validity of the rezoning of the parking <br />lot; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That Section 1103.02 of the Zoning Code of the Codified <br />Ordinances of the City of Lakewood be and the same is hereby amended by changing <br />and revising the Zoning Map to the extent that the property described as follows: <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and <br />State of Ohio and known as being part of Original Rockport <br />Township Section 21, bounded and described as follows: <br /> <br />Beginning at the southeasterly corner of Sublet No. 64 which <br />point is 131.85 feet north of the northerly line of Madison <br />Avenue which is the principal place of beginning, thence north <br />along the westerly line of Ridgewood Avenue, a distance of about <br />120 feet to point which is the northeasterly corner of Sublet <br />No. 66, thence westerly along the Northerly line of said sublet <br />a distance of about 144.08 feet to a ooint, thence southerly a <br />distance of about 120 feet to the southwesterly corner of <br />Sublet 64, thence easterly along the southerly line 6f said <br />sublet a distance of about 144.20 feet to a point which is the <br />principal place of beginning, be the same more or less, but <br />subject to all legal highways. <br /> <br />be and the same is hereby reclassified and changed from use classification R3 <br />(two family) to use classification BR (business residential). <br /> <br /> Section 2. The Planning Director is hereby authorized and directed <br />to make the reclassification change in the Zoning Map of the City of Lakewood, Ohio <br />so as to reflect the amendment designated in Section 1 of this Ordinance. <br /> <br /> Section 3. It is found and deten~ined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted <br />in an open ~metin§ of this Council, and that all such deliberations of~this~ <br />Council and of any of its committees that resulted in such formal action, were <br />in meetings open to the public, in compliance v~ith all legal requirements including <br />Section 121.22 of the Ohio Revised Code <br /> <br /> <br />
