<br /> AN EMERGENCY ORDINANCE to amend Section 902.04 of the Streets, Utilities
<br />and Public Services Code of the Codified Ordinances of the City of Lakewood to
<br />increase sewer service charges, effective January 1, 1981.
<br />
<br /> WHEREAS, the establishment of sewer service or rental charges is
<br />essential to provide sufficient funds for the operation, maintenance, repair
<br />and improvements of the storm and sanitary sewer systems of the City and any
<br />additional funds required for the operation, maintenance, repair and improvements
<br />to the Wastewater Treatment Plant, and
<br />
<br /> WHEREAS, the present sewer charge rate of nineteen cents (19¢) per
<br />100 cubic feet of water consumed is not adequate to cover the cost of constructing
<br />the required upgraded wastewater treatment facilities and-operating and maintaining
<br />these facilities, and
<br />
<br /> WHEREAS, the City must provide 25% of the capital costs for the upgraded
<br />wastewater facilities which have been mandated by the Environmental Protection
<br />Agency and operating and maintenance costs, which have risen at an average rate
<br />of 14% over the last three years, are predicted to increase at an average rate
<br />of 10% through 1985, and
<br />
<br /> WHEREAS, this ordinance constitutes an emergency measure providing
<br />for the immediate preservation of the public health, safety and welfare and for
<br />the usual daily operation of a municipal department; now, therefore,
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That Section 902.04 of the Streets, Utilities and
<br />Public Services Code of the Codified Ordinances of the City of Lakewood now
<br />reading as follows:
<br />
<br />902.04 SEWER SERVICE CHARGE.
<br />
<br /> For the purposes provided in Section 902.03, there is hereby
<br />levied and charged upon each lot, parcel of land or premises having a
<br />connection with the sewer system, or otherwise discharging sewage,
<br />industrial waste, water or other liquid, either directly or indirectly
<br />into the system, a sewer service or rental charge equal to nineteen
<br />cents (19¢) per 100 cubic feet of water consumed each quarter, as shown
<br />by the records of the Water Division of the City, based upon actual
<br />water meter readings. However, there shall be a minimum sewer service
<br />or rental charge of one dollar and ninety cents ($1.90) per quarter
<br />for each such lot, parcel of land or premises.
<br />
<br />shall be and the same is hereby amended to read as follows:
<br />
<br />902.04 SEWER SERVICE CHARGE.
<br />
<br /> For the purposes provided in Section 902.03, there is hereby
<br />levied and charged upon each lot, parcel of land or premises having a
<br />connection with the sewer system, or otherwise discharging sewage,
<br />industrial waste, water or other liquid, either directly or indirectly
<br />into the system, a sewer service or rental charge equal to fifty-two
<br />and one-half cents (52.5¢) per 100 cubic feet of water consumed each
<br />quarter, as shown by the records of the Water Division of the City,
<br />based upon actual water meter readings. However, there shall be a
<br />minimum sewer service or rental charge of five dollars and twenty-five
<br />cents ($5.25) per quarter for each such lot, parcel of land or premises.
