ORDINANCE NO. 86-80 <br /> <br />BY: Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling, <br /> Brown <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to advertise for bids <br />and enter into a contract or contracts with the lowest and best bidder or bidders <br />for the construction of the Phase I improvements to the Lakewood Wastewater <br />Treatment Plant and its ancillary systems in accordance with the Lakewood Facility <br />Plan. <br /> <br /> WHEREAS, it is incumbent upon the City to comply with Public Law <br />92-500, the Federal Water Pollution Control Act, and <br /> <br /> WHEREAS, the City of Lakewood has received a Step III Grant from <br />the Environmental Protection Agency in the amount of seventy-five percent (75%) <br />of the construction and related costs of the Phase I improvements to the City's <br />wastewater treatment facilities, and <br /> <br /> WHEREAS, on November 3, 1980 Council adopted Ordinance No. 76-80 which <br />provides for sewer service charges sufficient to cover the City's twenty-five <br />percent (25%) share of the construction and related costs for the Phase I <br />improvements, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health, safety and welfare and 'For <br />the further reason that it is in the best interest of the public service, <br />welfare and safety to proceed with the construction of the improvements to the <br />City's Wastewater Treatment Plant and the ancillary systems at the earliest <br />possible time; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directe~ <br />to advertise for bids and enter into a contract or contracts with the lowest and <br />best bidder or bidders after advertisement according to law for the construction <br />of the Phase I improvements to the Lakewood Wastewater Treatment Plant and its <br />ancillary systems in accordance with the Lakewood Facility Plan. <br /> <br /> Section 2. That the total estimated cost of the aforementioned <br />improvements is 517,881,100.00 of which the City's 25% Share is $4,470.275.00 <br />all of which is to be paid from the Sewer and Wastewater Treatment Plant Improvement <br />Fund. <br /> <br /> Section 3. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were- <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action <br />were meetings that were open to the public in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated i.n the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its adoption and approval by <br />the Mayor; otherwise it shall take effect and 'be in force after the earliest <br /> <br />period allowed by law. <br />Adopted: <br /> <br /> <br />
