ORDINANCE NO. 86-80 BY: Chinnock, Gallagher, Graham, McBride, Salmon, Wendling, Brown AN EMERGENCY ORDINANCE authorizing the Mayor to advertise for bids and enter into a contract or contracts with the lowest and best bidder or bidders for the construction of the Phase I improvements to the Lakewood Wastewater Treatment Plant and its ancillary systems in accordance with the Lakewood Facility Plan. WHEREAS, it is incumbent upon the City to comply with Public Law 92-500, the Federal Water Pollution Control Act, and WHEREAS, the City of Lakewood has received a Step III Grant from the Environmental Protection Agency in the amount of seventy-five percent (75%) of the construction and related costs of the Phase I improvements to the City's wastewater treatment facilities, and WHEREAS, on November 3, 1980 Council adopted Ordinance No. 76-80 which provides for sewer service charges sufficient to cover the City's twenty-five percent (25%) share of the construction and related costs for the Phase I improvements, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and 'For the further reason that it is in the best interest of the public service, welfare and safety to proceed with the construction of the improvements to the City's Wastewater Treatment Plant and the ancillary systems at the earliest possible time; now, therefore, OHIO: BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF Section 1. That the Mayor be and he is hereby authorized and directe~ to advertise for bids and enter into a contract or contracts with the lowest and best bidder or bidders after advertisement according to law for the construction of the Phase I improvements to the Lakewood Wastewater Treatment Plant and its ancillary systems in accordance with the Lakewood Facility Plan. Section 2. That the total estimated cost of the aforementioned improvements is 517,881,100.00 of which the City's 25% Share is $4,470.275.00 all of which is to be paid from the Sewer and Wastewater Treatment Plant Improvement Fund. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were- adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were meetings that were open to the public in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 4. That this ordinance is hereby declared to be an emergency measure for the reasons stated i.n the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise it shall take effect and 'be in force after the earliest period allowed by law.
