ORDINANCE NO. 88-80 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to make application to <br />the Environmental Protection Agency to amend the City's Step II Grant so as <br />to provide for the development of an industrial wastewater pretreatment <br />program, to accept the Step II Grant as amended, and to enter into a contract <br />with Watermation, Incorporated to perform the additional work required by <br />said amendment. <br /> WHEREAS, it is necessary for the City to comply wi th Public Law <br />92-500, the Federal Water Pollution Control Act, and <br /> WHEREAS, the Director of the Ohio Environmental Protection Agency, <br />in a Findings and Order dated October 30, 1980, has directed the City of <br />Lakewood to submit an approvable work plan to the Director by December 31, <br />1980 detailing the steps the City will take to conduct a survey of industrial <br />users of our treatment works, an inventory of prohibited and toxic discharges <br />into and through said treatment works, and investigations of sludge contamination <br />and possible violations of Water Quality Standards, and <br /> WHEREAS, the Environmental Protection Agency has advised the City that <br /> additional Step II funding can be made available upon the City's application <br /> to undertake this additional work and this Council is of the opinion that ~ <br /> it is in the best interests of the City to so undertake this additional work, <br /> and <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br /> for the usual daily operation of a municipal department and for the further <br /> reason that it is in the best interests of the public health, s~fety and <br /> welfare of the City to proceed with'the Step II work relating to the City's <br /> wastewater treatment facilities without delay; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> OHIO: <br /> Section 1. That the Mayor be and he is hereby authorized and <br /> directed to make application to the Environmental Protection Agency to <br /> amend the City's Step II Grant in the amount of $44,075.95 to provide for the <br /> 75% federal share of the estimated cost to develop an industrial wastewater <br /> pretreatment program as directed by the Ohio Environmental Protection Agency. <br /> Section 2. That the Mayor be and he is hereby authorized and- <br /> directed upon approval of the aforementioned amendment to the City's Step II <br /> Grant by the Environmental Protection Agency to accept said grant as amended. <br /> Section 3. That upon acceptance of the aforementioned Step II Grant <br /> as amended, the Mayor be and he is hereby authorized and directed to enter into <br /> a contract with Watermation, Incorporated, 2304 University Avenue, St. Paul, <br /> Minnesota, as consulting engineers for the purpose of per. forming the work <br /> necessary to develop the aforementioned industrial wastewater pretreatment <br /> program. <br /> Section 4. That the total estimated cost of the aforementioned <br /> additional work is $58,767.93 of which the City's 25% share is $14,691.98 all <br /> of which is to be paid from the Sewer and Wastewater Treatment Plant Improvement <br /> Fund. <br /> Section 5. It is found and determined that all formal actions of <br /> this Council concerning and relating to the passage of this Ordinance were <br /> adopted in an open meeting of this Council, and that all said deliberations <br /> of this Council and that of any of its committees 'that resulted in such <br /> formal action, were in meetings open to the public in accordance with all <br /> legal requirements including Section 121.22 of the Ohio Revised Code. <br /> <br /> <br />
