ORDINANCE NO. 89-80 <br /> <br />BY:Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling, <br /> Brown <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to make application to <br />The Environmental Protection Agency to amend the City's Step II Grant so as <br />to provide additional design effort required to increase the size of the <br />retention basin at the Wastewater Treatment Plant and correspondingly reduce <br />the size of retention basins located elsewhere in the system, to accept the <br />Step II Grant as amended, and to enter into a contract with Watermation, Inc. <br />to perform the additional work required by said amendment. <br /> <br /> WHEREAS, it is necessary for the City to comply with Public Law <br />92-500, the Federal Water Pollution Control Act, and <br /> <br /> WHEREAS, the Value Engineering view of our Step II Design of the <br />Lakewood upgraded wastewater treatment system has revealed that a substantial <br />overall savings can be effected by increasing the size of the retention basin <br />at the wastewater treatment plant-site and making corresponding reductions in <br />size of retention basins located elsewhere in the system, and <br /> <br /> WHEREAS, the City has a proposal from Watermation, Inc. to carry out <br />the necessary additional design effort at a cost of $39,477.02 to. be added to <br />their existing Step II Design Contract, and <br /> <br /> WHEREAS, The Environmental Protection Agency has advised the City 'that <br />additional Step II funding can be made available upon the City's application to <br />undertake this additional work and this Council is of the opinion that it is in <br />the best interests of the City to so undertake this additional work, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department and for the further reason <br />that it is in the best interests of the public health, safety and welfare of the <br />City to proceed with the Step II work relating to the City's wastewater treatment <br />facilities without delay; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to make application to The Environmental Protection Agency to amend the City's <br />Step II Grant in the amount of $29,607.77 to provide for the 75% federal share <br />of the estimated cost to make design changes in the retention basins which are <br />to be a part of our upgraded wastewater treatment facilities. <br /> <br /> Section 2. That the Mayor be and he is hereby authorized and'-directed <br />upon approval of the aforementioned amendment to the City's Step II Grant by The <br />Environmental Protection Agency to accept said Grant as amended. <br /> <br /> Section 3. That upon acceptance of the aforementioned Step II Grant, <br />as amended, the Mayor be and he is hereby authorized and. directed to enter into <br />a contract with Watermation, Inc., 2304 University Avenues St. Paul, Minnesota, <br />as Consulting Engineers for the purpose of performing the'work necessary to <br />redesign the aforementioned retention basin. <br /> <br /> Section 4. That the total estima'ted cost of the aforementioned <br />additional work is $39,477.02, of which the City's 25% share is $9,869.26, which <br />is to be paid from the Sewer and Wastewater Treatment Plant Improvement Fund. <br /> <br /> Section 5. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this Ordinance were <br />adopted in an open meeting of this Council, and that all said deliberations of <br />this Council and that of any of its committees that resulted in such formal <br />action, were in meetings open to the public in accordance with all legal <br />requirements including Section 121.22 of the Ohio Revised Code. <br /> <br /> <br />
