ORDINANCE NO. 3-81 BY: <br /> <br />Salmon, Wendling, Brown, <br />Chinnock, Galllagher, <br />Graham, McBride <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 303.02 of the Traffic Code <br />of the Codified Ordinances of the City of Lakewood to authorize designated <br />uniformed officers and members of the Lakewood Fire Department to issue <br />citations for prohibited fire lane parking violations. <br /> <br /> WHEREAS, this Council is of the opinion that it would be in the <br />best interests of the City to have uniformed officers and members of the Fire <br />Department to also be responsible for the enforcement and ticketing of illegally <br />parked motor vehicles in designated fire lanes, and <br /> <br /> WHEREAS, under our present ordinances, only the officers of the Division <br />of Police are authorized to issue such citations and said ordinances should <br />be amended to give members of the Fire Department similar authority with respect <br />to the enforcement of Section 351.01(q) of our ordinances, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public safety and welfare and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br />OHIO: <br /> <br /> Section 1. That Section 303.02 of the Traffic code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />303.02 DUTIES OF POLICE AND FIREMEN. <br /> <br /> (a) It shall be the duty of the Division of Police under the <br />charge of the Mayor, as required by the Charter, to enforce the <br />provisions of this Traffic Code. Officers of the Division of Police <br />are hereby authorized to direct all traffic either in person or by <br />means of visible or audible signal in conformance with the provisions <br />of this Traffic Code, provided that in the event of a fire or other <br />emergency or to expedite traffic or safeguard pedestrians, officers <br />of the Division of Police or Division of Fire may direct traffic, <br />as conditions may require, notwithstanding the provisions of this <br />Traffic Code. <br /> <br /> (b) No person shall fail to comply with any lawful order or <br />direction of any police officer or fireman issued pursuant to this <br />section. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />303,02 DUTIES OF POLICE AND FIREMEN. <br /> <br /> (a) It shall be the duty of the Division of Police under the <br />charge of the Mayor, as required by the Charter, to enforce the <br />provisions of this Traffic Code.
