ORDINANCE NO. 102-81 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ordinance authorizing and directing the. Director of <br />Public Safety to enter into a contract for. the repair of the Fire Department <br />elevating platform fire truck without formal bidding and advertising. <br /> <br /> WHEREAS, pursuant to Ohio R.C. 735.051, the legislative authority <br />may by two-thirds vote authorize the Director of .Public Safety to enter into <br />a contract for work to be done without formal bidding and advertising in a case <br />of a real and present emergency arising in connection with the maintenance <br />of equipment of the Department of Public Safety; and <br /> <br /> WHEREAS, this Council is advised that due to a continuing problem <br />with the rear end suspension of .the elevating platform fire truck operated by <br />the Fire Department said fire truck .must be taken out of service, and <br /> <br /> WHEREAS, in order to properly maintain the operation of the Fire <br />Department of the City, it is immediately necessary to enter into a contract <br />for the repair and replacement of the rear end suspension o.f the aforementioned <br />fire truck, and <br /> <br /> WHEREAS, this Council is advised that the Duplex Truck Division of <br />The Nolan Company is the only known local concern which is able to do the work <br />desired, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the usual daily operation of a municipal department and it is immediately nec- <br />essary to enter into said repair contract for the immediate preservation of the <br />public health, safety, and welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKE~OOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor, as Director of Public Safety be and he is <br />hereby authorized and directed to enter into a contract with Duplex Truck Divi- <br />sion of The Nolan Company, Gundy Drive, Midvale, Ohio, 44653, for the repair <br />and replacement of the rear end suspension of the Fire Depar%ment elevating <br />platform fire truck without formal bidding and advertising. <br /> <br /> Section 2. That the sum of $15,000 which is estimated to be the cost <br />of the aforementioned repair is hereby appropriated from the unappropriated <br />balance of the General Fund. <br /> <br /> Section 3. It i-s found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were.~ adopted <br />in an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements including Section <br />121,22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its .adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />Adopted: <br /> I <br /> <br />Approved <br /> <br /> <br />
