<br />is hereby amended and shal¡ henGeforth read as follows: <br /> <br />"¡'hat it is hereby declared necessary to issue <br />bonds of the City of Lakewood in the principal <br />amount of $50,000 in anticipation of the levy <br />and collection of special assessments for the <br />purpose of paying the property owners' portion <br />of the cost of i~proving the municipal easement <br />described in Resolution No. 91-81 adopted Sep- <br />tember 21, 1981, by constructing therein a con~ <br />crete modular breakwal1 and shore return at each <br />termination of the breakwa11 together with <br />necessary appurtenances thereto. II <br /> <br />Section 2. Section 3 of Ordinance 92-81 which states: <br /> <br />"That it is necessary and this Council hereby <br />determines that notes in the principal amount of <br />$25,000 shall be issued in anticipation of the <br />issuance of said bonds." <br /> <br />is hereby amended and shall henceforth read as follows: <br /> <br />"That it is necessary and this Council hereby <br />determines that notes in the principal amount of <br />$50,000 shall be issued in anticipation of the <br />issuance of said bonds." <br /> <br />Section 3. Except as amended by this Ordinance, Ordinance No. <br />92-81 is hereby confirmed, approved and ratified. <br /> <br />Section 4. The Clerk of Council is hereby directed to forward <br />a certified copy of this ordinance to the County Auditor. <br /> <br />Section 5. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council, and that all delibera- <br />tions of this Council and of any of its committees that resulted in such <br />formal action, were in meetings open to the public, in compliance with <br />all legal requirements including Section 121.22 of the Ohio Revised Code. <br /> <br />Section 6. That this ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the public <br />peace, property, health, safety and welfare in the City for the reasons <br />set forth and defined in the preamble to -this ordinance and provided it <br />receives the affirmative vote of two-thirds of all members elected to <br />Council, this ordinance shall take effect and be in force immediately <br />upon its adoption by the Council and approval by the Mayor; otherwise, <br />it shall take effect and be in force after the earliest period allowed <br />by law. <br /> <br />Passed: <br /> <br />~7 <br /> <br />, 1981 <br /> <br />¡¡£~£1;8~ <br /> <br />~ce~ <br /> <br />APproved~ <br /> <br />7 <br /> <br />1981 <br /> <br />~~.~. <br />_ ayor <br /> <br />- <br /> <br />- 2 <br />
