(c) The Board shall determine that the applicant <br />is the owner or owners agent of the property in <br />question and that the owner will, in writing, agree <br />to comply with such conditions and restrictions as <br />may be imposed by the Board and all applicable <br />ordinances. <br /> <br />(d) The Board affirmatively finds that the proposed <br />parking use, subject to such conditions and restrictions <br />as it may impose, will not result in substantial <br />detriment to neighboring property. <br /> <br />(e) In establishing conditions and restrictions, if <br />any, the Board shall consider, for the protection of <br />the neighborhood, the length of time for construction, <br />maintenance, screening, fences, walls, landscaping, <br />lighting, evening use, need for landscape space <br />15 feet wide between sidewalk and parking lot, and <br />uses other than parking for customers and employees, <br />provided that the design of the proposed parking area <br />has been approved by the Architectural Board of Review. <br /> <br />(f) If City Council fails to concur with the recom- <br />mendations of either or both .the Architectural Board <br />of Review and the Board of Zoning Appeals, then <br />it will direct the matter back to the appropriate <br />Board. <br /> <br /> Section 2. If it is found and determined that all for- <br />mal actions of this Council concerning and relating to the <br />passage of this ordinance were adopted in an open meeting of <br />this Council and of any of its committees that resulted in such <br />formal action, were in meetings open to the public, in com- <br />pliance with all legal requirements including Section 121.22 <br />of the Ohio Revised Code. <br /> <br /> Section 3. That this Ordinance shall take effect and <br />be in force from and after the earliest period allowed by law <br />and all ordinances or parts of ordinances inconsistent <br /> <br />herewith, are hereby repealed. <br />Adopted: <br /> <br />Approved: ~~ ~/. / ~ ~1 <br /> I ' <br /> <br /> <br />
