ORDINANCE NO. 13-81 <br /> <br />BY: Brown, Chinnock, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN E~'~ttGENCY ORDINANCE authorizing settlement in the case of the <br />City of Lakewood v. United States Fire Insurance Co., Case No. 80-01937CV, <br />authorized in Resolution No. 5461 adopted April 7, 1980. <br /> <br /> ~RI[AS, pursuant to Resolution No. 5461, the City of Lake~ood Law <br />Department filed the lawsuit, City of Lakewood v. United States Fire Insurance <br />Co., and <br /> <br /> WHFttEAS, since the filing of said lawsuit the Law Department has <br />conducted negotiations for the successful settlement of the pending case, and <br /> <br /> WHEREAS, negotiations conducted have lead to an offer made by the <br />defendant, United States Fire Insurance Co., and <br /> <br /> Wt{EtlEAS, said offer made is deemed fair and in the best interests <br />of the City and, <br /> <br /> ~IEREAS., this ordinance constitutes an emergency measure in that it <br />will save the City further costs of suit and in that it provides for the usual <br />daily operation of a municipal department; now, therefore, <br /> <br />OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF IAKE~OOD, STATE OF <br /> <br /> Section 1. That Council hereby authorizes the settlement of the <br />claim made by the City in the City of Lakewood v. United States Fire Insurance <br />Co., Case No. 80-01937CV in the amount of $64,000.00 and authorizes the Director <br />of Finance to accept said sums in full settlement of the claim of the City and <br />to dispurse the funds to the appropriate accounts. <br /> <br /> Section 2. That the Director of Law be and he is hereby authorized <br />and directed to sign on behalf of the City of Lakewood a Judgment Entry settling <br />and dismissing ~vith prejudice and at defendant's costs, Case No. 80-01937CV, <br />City of Lakewood v. United States Fire Insurance Co., currently pending in the <br />Court of Common Pleas of Cuyahoga County. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force inmediately upon its adoption and approval by the <br />Mayor; otherwise it shall take effect and be in force from and after the <br />earliest period allowed by law. <br /> <br /> President <br /> <br />Approved:__ <br /> <br /> <br />
