(5) The necessity of this facility to a waterfront location, where appl i cable; (6) The availability of alternative locations, for the proposed use which are not subject to flooding or erosion damage; (7) The compatibility of the proposed use with existing and anti cipated development; (8) The relationship of the proposed use to the comprehensive plan and flood plain management program for that area; (9) The safety of access to the property in times of flood for ordinary and emergency vehicles; (i0) The expected heights, velocity, duration, rate of rise and sediment transport of the flood waters and the effects of wave action, if applicable, expected at the site; and, (e) Generally, variances may be issUed for new construction and sub- stantial improvements to be erected on a lot of one-half acre or less in size contiguous to and surrounded by lots with existing structures constructed below the base flood level, providing sub- sections (d)(1) to (11) hereof have been fully considered. As the lot size increases beyond one-half acre, the technical justification required for issuing the variance increases. (f) Upon consideration of' the factors of subsection (d) hereof and the purposes of this Code, the Board may attach such conditions to the granting of variances as it deems necessary to further the purposes of this Code. (g) The Building Commissioner shall maintain the records of all appeal actions and rePort any variances to the Federal Insurance Adminis- tration upon request. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise it shall take effect and be in force after the earliest period allowed by law, and that Section 1307.15, adopted January 16, 1978, shall be and same is hereby repealed at that time.
