ORDINANCE NO. 29-81 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> <br /> AN EMERGENCY ORDINANCE to appropriate the real property situated <br />at the southwest corner of Merl Avenue and Bunts Road in the City of Lakewood, <br />and bearing Permanent Parcel #312-23-24. <br /> <br /> WHEREAS, on the 19th day of March, 1981, the Council of the City of <br />Lakewood adopted Resolution No. 5546 declaring the necessity and intention of <br />appropriating the land hereinafter described, notice of the adoption of <br />which Resolution has been served on the owners, person in possession thereof, <br />or having an interest or record in said land, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br />the immediate preservation of public health and welfare and for the usual daily <br />operation of a municipal department, now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section I. That the fee simple interest in and to the following real <br />estate be and the same is hereby appropriated for the purpose of establishing <br />a public park and children's playground in the City of Lakewood, Ohio: <br /> <br /> Situated in the City of Lakewood, County of Cuyahoga and <br />State of Ohio, and .known as being part of Original Rockport Town- <br />ship Section No. 22 and bounded and described as follows: <br /> <br /> Beginning at the intersection of the Northerly right of way <br />line of the Norfolk and Western Railway Company with the Westerly <br />line of premises conveyed to Mary~A. Worthen by deed recorded in <br />Volume 235, Page 572 of Cuyahoga County Records; <br /> <br /> Thence North 1© 4' 00" West along the Westerly line of premises <br />so conveyed 85.70 feet to the Southeasterly side of Merl Avenue; <br /> <br /> Thence Northeasterly in a direct line about 98 feet to a point <br />in the Southerly line of Merl Avenue as shown by recorded plat in <br />Volume 80, Page 2 of Cuyahoga County Records, said point being West- <br />erly 304.02 feet to a point of curve; <br /> <br /> Thence North 89° 291 30" East along the Southerly line of Merl <br />Avenue 304.02 feet to a point of curve; <br /> <br /> Thence Southeasterly 54.44 feet along the arc of a circle de- <br />flecting to the right, having a radius of 38.09 feet and a chord <br />which bears South 49© 34' 03" East 49.92 feet to a point of reverse <br />curve; <br /> <br /> Thence Southeasterly 69.13 feet along the Westerly curved line <br />of Bunts Road, being the arc of a circle deflecting to the left hav- <br />ing a radius of 408.66 feet and a chord which bears South 13© 28' 22" <br />East 69.05 feet to the Northerly line of the right of way of the <br />Norfolk and Western Railway Company; <br /> <br /> Thence South 89© 29' 30" West along said Westerly line 454.64 <br />feet to the place of beginning, be the same more or less, but subject <br />to all legal highway. <br /> <br />Permanent Parcel No. 312-23-24 <br /> <br /> Section 2. That the Mayor be and he is hereby authorized and directed <br />to offer and to pay to the Cleveland Electric Illuminating Company the sum of <br />$60,000.00 for the purchase of the aforementioned property situated at the <br />southwest corner of Merl Avenue and Bunts Road in the City of Lakewood and <br />said funds are now and hereby appropriated from the unappropriated <br />balance of the General Fund. <br /> <br /> <br />
