ORDINANCE NO~ 30-81 <br /> <br />BY:Brown, Chinnock, <br /> Graham, McBride, <br /> Wendllng <br /> <br />Gallagher, <br />Salmon, <br /> <br /> AN ORDINANCE authorizing the Mayor to enter into an indemnity and <br />release agreement with Walter William Walzer and The Metal Equipment Company <br />for and on behalf of the City of Lakewood as a member of the Westshore <br />Enforcement Bureau with respect to a bomb disposal vehicle donated to the <br />Westshore Enforcement Bureau by the said Walter William Walzer and The Metal <br />Equipment Company. <br /> <br /> WHEREAS, the Westshore Enforcement Bureau consisting of the cities <br />of Bay Village, Fairview Park, Lakewood, North Olmsted, Rocky River, and West- <br />lake, have been donated a bomb disposal vehicle by Walter William Walzer of <br />The Metal Equipment Company, and <br /> <br /> WHEREAS, the said Walter William Walzer of The Metal Equipment Com- <br />pany has requested that the Westshore Enforcement Bureau and its members in- <br />demnify and save harmless the said Walter William Walzer and The Metal Equip- <br />ment company from any and all liability or claim which may result from the <br />maintenance and operation of said vehicle, and <br /> <br /> WHEREAS~ said bomb disposal vehicle has been examined and approved <br />by the Westshore Enforcement Bureau and the City of Lakewood is willing to <br />authorize the Mayor to enter into such an indemnity agreement as aforesaid, <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor b~ and he is hereby authorized and directed <br />to enter into an Indemnity and Release Agreement with Walter William Walzer <br />and The Metal Equipment Company for and on behalf of the City of Lakewood as <br />a member of the Westshore Enforcement Bureau. Said Indemnity and Release Agree- <br />ment is to be substantially in the form as attached hereto marked as Exhibit "A" <br />and made a part hereof. <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted <br />in an open meeting of this Council, and that all such deliberation of this <br />Council and of any of its committees that resulted in such formal action, were <br />in meetings open to the public, in compliance with all legal requirements in- <br />cluding Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3, That this Ordinance shall take effect and be in force <br />from and after the earliest period allowed by law. ~ <br /> <br /> ~/PRE'SI DENT v , - <br /> <br />Approved: ~71 /~d~/ <br /> <br /> <br />
