OROtI~ANCE NO. : 34-81 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN ENERGENCY ORDINANCE creating the Rubbish Truck Collection Equip- ment Fund, and appropriating funds and declaring an emergency. WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department, and WHEREAS (16) 3] haul to it is the intent of Lakewood City Council to purchase sixteen cubic yard rubbish collection trucks so as to allow direct the landfill, and WHEREAS, the United States E.P.A. has forced the City to make this decision regarding its rubbish hauling, and WHEREAS, it is the intent of the Council to borrow approximately 1.3 million dollars so as to allow the purchase of these trucks; now, therefore, BE IT ORDAINED BY THE COUNCIb OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Rubbish Collection Truck Equipment Purchase Fund now and is hereby established. Section 2. That the sum of $1,300,000 is now and hereby appropriated by the Council of the City of Lakewood, Cuyaho§a County, Ohio for the purchase of said vehicles. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passages of this ordinance were adopted in an open meeting of this Council, and that all such delibera- tions of this Council and of any of its committees that resulted in such formal actions, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 4. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirma%ive vote of two-thirds of all members elected to CoUncil, and is approved by the Mayor, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
