ORDINANCE NO, 35-811. <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, Wendling <br /> <br />AN EMERGENCY ORDINANCE creating the PrecipitatOr Demolition Fund, <br />and appropriating funds and declaring an emergency. <br /> <br />~HEREAS, this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department, and <br /> <br />WHEREAS, it is the intent of the Council of the City of Lakewood to go <br />to a direct haul to land fill for refuse disposal, and <br /> <br />WHEREAS~ it is the intent of the Council to demolish the electrostatic <br />precipitator, scrubber, and connecting metal ducting at the incincera- <br />tor site, and <br /> <br />WHEREAS, the Council is borrowing $50,000 to complete this task; now,. <br />therefore <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />SectiOn 1. There is now and hereby created the Precipitator Demolition <br />Fund. <br /> <br />Section 2. There is now approoriated the sum of $50,000 to complete <br />the demolition of the electrostatic orecioitator, scrubber and <br />connecting metal ducting at the incinerator. <br /> <br />Section 3. It is foune ano determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were <br />aaoo~ea in an eden meeting of this Council and that all sucn delibera- <br />tions of tn~s Council ano of any of ~s committees t~at resul~e~ in <br />sucn formal actions, were ~n meetings eden to the oublic, in comotiance <br />w~th all legal reeu~remen~s including Section 121.22 of the Ohio <br />Revlsem Code. <br /> <br />Section 4. That ~his ordinance is nere~y declared to be an emergency <br />measure for the reasons s~atee in the oreamble qereof and provided it <br />receives ~ne affirmative vote of ~wo-chirds of all members elected to <br />Council, ana is approvee Dy ~ne Mayor, it shall take effect ano De in <br />force ~mmediaCely upon its auoetion ane approval Dy the Mayor. <br /> <br />Adopted: <br /> <br />/?// <br /> <br />Approved: <br /> <br /> <br />
