and other surveys, plans, specifications profiles and estimates and of printing, serving and publishing notices, resolutions and ordinances, the amount of damages resulting from the imp.rovement assessed in favor of any owner of land affected by the i~provement and the interest thereon, the costs incurred in connection with the preparation, levy and collection of the special assessments, the cost of pur- chasing, appropriating and otherwise acquiring therefor any required real estate or interests therein, expenses of legal services including obtaining an approv- ing legal opinion, cost of labor and material and interest on bonds and notes issued in anticipation of the levy and collection of the special assessments together with all other necessary expenditures. Section 5. That the list of estimated assessments as heretofore prepared by the Director of Finance be and the same is hereby approved and the assessments so to be levied shall be paid in twenty semi-annual install~ ments, with interest on deferred payments at the same rate as shall be borne by the bonds to be issued in anticipation of the collection thereof, provided that the owner of any property to be assessed may, at his option, pay such assessment in cash within thirty days after the passage of the assessing ordinance. Section 6. That obligations of the City shall be issued,~'in antici- pation of the collection of special assessments by installments &nd in an amoUnt equal thereto, for the purpose of providing funds to p~y the cost of this improvement. Section 7. That the remainder of the ent~e cost of this improve- ment, after application of the assessments her~£~rovided shall be paid by the issuance of notes and bonds of the Ci~y~3£~~ the manner provided by law. Section 8. That pursua~'~o Article XIV, Section 16 of the Charter of the City, the Director of ~l~ic Works has heretofore certified to this Council that his estimat~/thelife of the improvement described in Sections 1 and 2 hereof is tw~%~fZfive years. · Section 9. That the Director of Public Works be and he is hereby authorized and directed as soon as the funds therefor are available to make and execute a contract for said improvement with the lowest and best bidder after advertising according to law. Section 10. That the Clerk of this Council be and she is hereby directed to deliver to the Auditor of Cuyahoga County a certified copy of this ordinance within fifteen days following its passage. Section 11. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliber- ations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 12. ~nat this ordinance, ha~ing been declared to be an emergency ~easure, shall be in full force and effect from and immediately after its passage and approval by the Mayor.
