ORDINANCE NO. 57-81 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Section 1325.04 of the Building Code of the Codified Ordinances of the City of Lakewood, relating to the authority of the Architectural Board of Review. WHEREAS, currently, the Architectural Board of Review is limited to commercial buildings, store fronts, and exterior buildings in commercial areas, and WHEREAS, this Council determines it to be in the best interest of the City that there be a more uniform application and review by the Architectural Board of Review of new construction. WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare and for the usual operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section ]325.04 of the Building Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 1325.04 AUTHORITY OF BOARD. The Board shall have the authority and it shall be the dury of the Board to review all applications filed in the Building De- partment to renovate and alter store fronts and exterior of buildings in commercial areas of the City and to review all applications filed for the construction of new commercial build- ings in the City as may be referred to the Board by the Building Commissioner from time to time. shall be and the sarr~ is hereby amended to read as follows: ]325.04 AUTHORITY OF BOARD. The provisions of Chapter 1325 of these Codified Ordinances shall apply to all new construction and construction which alters exterior elevations wheresoever situated within the City of Lakewood, including construction by the City. -The Building Commissioner shall, as he deems necessary, ~ file all drawings, data, reports, and complaints received with the Architectural Board of Review.respecting applica- tions for building permits wherein the purposes of Section 1325;03 apply. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal, action were in meetings open to the public, in compliance with all legal requirements includ- ing Section ]21.22 of the Ohio Revised Code.
