in the transcript of proceedings, which shall set forth (in brief and su~nary <br />terms) the facts and estimates on which the City's reasonable expectations as <br />to future events are based and state that, to the best of the knowledge and <br />belief of the certifying officer, the City's expectations are reasonable. <br /> <br /> Section 9. That the Director of Finance, as fiscal officer of the <br />City, is t~reby directed to forward a certified copy of this Ordinance to <br />the County Auditor of Cuyahoga County and to secure a receipt therefor. <br /> <br /> Section 10. It is hereby determined and recited that all acts, <br />conditions and things necessary to be done precedent to and in the issuing <br />of the Notes in order to make the same legal, valid and binding obligations <br />of the City of Lakewood will have happened, been done and performed or will <br />happen, be done and performed in regular and due form as required by law; <br />and that no limitation of indebtedness or taxation, either statutory or <br />con~hutional, will have been exceeded in the issuance of said Notes. <br /> <br /> Section 11. That the Mayor and Director of Finance or either of them <br />are hereby authorized to prepare, execute and deliver to the purchaser of the <br />Notes a preliminary and final Official Statement or other appropriate disclosure <br />docun~t of the City in connection with the sale and delivery of the Notes. <br /> <br /> Section 12. That i t is found and determined that all formal actions <br />of this Council concerning and relating to the adoption of this OrdLnance <br />were adopted in an open meeting of this Council, and that all deliberations <br />of this Council and of any of its c~dttees that resulted in such formal <br />action, were in meetings open to the public, in compliance with all legal <br />requir~nts, including the Charter and Codified Ordinances of the City and <br />Section 121.22 of the Revised Code of Ohio. <br /> <br /> Section 13. That this Ordinance is hereby declared to be an <br />emergency measure necessary for the inmediate preservation of the public peace, <br />health, safety and welfare in the City for the reasons set forth and defined <br />in the preamble to this Ordnance and provided it receives the affirmative <br />vote of tuo-thirds of all members elected to Council, it shall take effect <br />and be in force ~iate!y upon its adoption and appro¥~l by the ~yor; <br />otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />-3- <br /> <br /> <br />
