ORDINANCE NO. 81-81 BY: <br /> <br />Brown, Chinnock, Gallagher, <br />Graham, McBride, Salmon, <br />Wendling <br /> <br />AN EMERGENCY ORDINANCE authorizing the Mayor to execute a contract retain- <br />ing Ernst & Whinney to perform as an independent auditor and accounting consult- <br />ants for the City of Lakewood, Ohio. <br /> <br />WHEREAS, the Director of Finance had solicited proposals from accounting <br />firms to provide an independent audit and consultations for the City of <br />Lakewood, and <br /> <br />WHEREAS, the Director of Finance and the Finance Committee feel that an <br />independent audit will be less costly, more fiscally accountable and <br />creditable, and <br /> <br />WHEREAS, an independent audit will comply with the concept of full dis- <br />closure and further comply with the desires of independent bond agencies, <br />and <br /> <br />WHEREAS, the proposal from Ernst & Whinney was the lowest and best re- <br />ceived, and <br /> <br />WHEREAS, the Finance Committee has recommended the proposal from Ernst & <br />Whinney; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Mayor be and he is hereby authorized and directed <br />to execute a contract (in a form substantally similar to the proposal <br />attached to this ordinance as Exhibit A) engaging the firm of Ernst & <br />Whinney as independent auditors and acting consultants to provide pro- <br />fessional accounting services to the City as an independent contractor. <br /> <br />Section 2. That to pay for the services and exp~nses of Ernst & Whinney <br />there is hereby appropriated sufficient amounts from the funds to be <br />audited. <br /> <br />Section 3. The Contract authorized by Section 1 of this Ordinance shall <br />be approved as to form and correctness by the City's Director of Law. <br />The City's Director of Finance is hereby directed to execute an approp- <br />riate certificate as to the availability of funds to pay Ernest & Whinney <br />for its services rendered under such Contract~ <br /> <br />Section 4. It is hereby found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all deliberations of <br />this Council and of any of its committee that resulted in such formal <br />actions, were in meetings open to the public in compliance with all legal <br />requirements including the City's Charter and Codified Ordinances and Section <br />121.22 of the Ohio Revised Code. <br /> <br />Section 5. This ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Cnuncil, it <br />shall take effect and be in force immediately upon its adoption and <br />approval by the Mayor; otherwise, it shall take effect and be in force <br />after the earliest period allowed by law.~ ~ <br /> <br />Approved: <br /> <br /> <br />
