ORDINANCE NO. 82-81 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing the Mayor on behalf of the City to enter into a contract by and between the 'City of Lakewood and the City of Rocky River for the treatment and disposal of sewage from approximately fifteen (15) acres of the City of Rocky River. WHEREAS, on or about September 10, 1956, the City of Lakewood entered into an agreement with the City of Rocky River for the treatment of sanitary sewage being discharged from an area i.n the City of Rocky River containing ap- proximately fifteen (15) acres, and -WHEREAS, it is now become necessary to increase the rates charged for said treatment and the City of Rocky River has agreed to pay such increased rates, and WHEREAS, this ordinance constitutes an emergency measure providing for the immedate preservation of the public health, safety, and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE: OF OHIO: Section 1. That the Mayor be and he is hereby authorized and directed to enter into an agreement with the City of Rocky River for the treatment of sanitary waste being discharged from approximately 109 single family residences located in an area of the City of Rocky River containing approximately 15 (fif- teen) acres, said agreement to be substantially in the form as set forth in Exhibit "1" attached hereto and made a part hereof. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meet- ings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. That this ordinance is hereby declared to be an emergencs measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed Adopted: - ~~ L' /~I . !
