ORDINANCE NO. 82-81 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor on behalf of the City <br />to enter into a contract by and between the 'City of Lakewood and the City of <br />Rocky River for the treatment and disposal of sewage from approximately fifteen <br />(15) acres of the City of Rocky River. <br /> WHEREAS, on or about September 10, 1956, the City of Lakewood entered <br />into an agreement with the City of Rocky River for the treatment of sanitary <br />sewage being discharged from an area i.n the City of Rocky River containing ap- <br />proximately fifteen (15) acres, and <br /> -WHEREAS, it is now become necessary to increase the rates charged <br />for said treatment and the City of Rocky River has agreed to pay such increased <br />rates, and <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the immedate preservation of the public health, safety, and welfare, and for <br />the usual daily operation of a municipal department; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE: OF OHIO: <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br /> to enter into an agreement with the City of Rocky River for the treatment of <br /> sanitary waste being discharged from approximately 109 single family residences <br /> located in an area of the City of Rocky River containing approximately 15 (fif- <br /> teen) acres, said agreement to be substantially in the form as set forth in <br /> Exhibit "1" attached hereto and made a part hereof. <br /> Section 2. It is found and determined that all formal actions of <br /> this Council concerning and relating to the passage of this ordinance were adopted <br /> in an open meeting of this Council, and that all such deliberations of this Council <br /> and of any of its committees that resulted in such formal action, were in meet- <br /> ings open to the public, in compliance with all legal requirements including Section <br /> 121.22 of the Ohio Revised Code. <br /> Section 3. That this ordinance is hereby declared to be an emergencs <br /> measure for the reasons stated in the preamble hereof and provided it receives <br /> the affirmative vote of two-thirds of all members of Council, it shall take <br /> effect and be in force immediately upon its adoption and approval by the Mayor; <br /> otherwise, it shall take effect and be in force after the earliest period allowed <br /> <br /> Adopted: - ~~ L' /~I . <br /> ! <br /> <br />Approved: <br /> <br /> <br />
