Warranty Deed to the City of Lakewood, together with guarantee of <br />title disclosing the said real estate to be free and clear of all encumbrances <br />excepting taxes and assessments not yet due and payable, zoning ordinances <br />and restrictions of record, if any; and that the Director of Finance be and <br />he is hereby authorized to pay the City's sh~re of expenses incidental to <br />the completion of the purchase, including the cost of the Deed, one-half <br />of the escrow fee and any prorata share chargeable to the City as purchaser. <br /> Section 3. The cost of the purchase of said property shall be paid <br /> from the Hospital fund - plant replacement restricted fund. <br /> Section 4. It is found and determined that all formal actions of <br /> this Council concerning and relating to the passage of this ordinance were <br /> adopted, in an open meeting of this Council, and that all said deliberations <br /> of this Council and that of any of its committees that resulted in such for- <br /> mal action, were in meetings open to the public in accordance with all legal <br /> requirements including Section 121.22 of the Ohio Revised Code. <br /> Section 5. That this ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided it receives <br /> the affirmative vote of two-thirds of all members elected to Council, it <br /> shall take effect and be in force in~ediately upon its adoption and approval <br /> by the Mayor, otherwise it shall take effect and be in force from and after <br /> the earliest period allowed by law. <br /> <br /> <br />
