been filed; but if it should be determined that any claims have been filed, they shall be inquired into before the commencement of the proposed improvement, and the Director of Law shall be, and he is hereby authorized and directed to institute legal proceedings in m court of competent juris- diction to inquire into any claims so filed. Section 4. That one hundred percent (100%) of the whole cost of said improvement to be borne by the City shall be assessed by the benefits upon all lots and lands bounding and abutting upon the proposed improvement between the termini aforesaid, which said lots and lands are hereby determined to be specially benefited by said improvement; and the cost of said improvement shall include the cost of preliminary and other surveys, plans, specifications, profiles and estimates and of printing, serving and publishing notices, resolutions and ordinances, the amount of damages resulting from the improvement assessed in favor of any owner of land affected by the improvement and the interest thereon, the costs incurred in connection with the preparation, levy and collection of the special assessments, the cost of purchasing, appropriating and otherwise acquiring therefor any required real estate or interests therein, expenses of legal services including obtaining an approving legal opinion, cost of labor and material and interest on bonds and notes issued in anticipa- tion of the levy and collection of the special assessments together with all other necessary expenditures. Section 5. That the list of estimated assessments as hereto- fore prepared by the Director of Finance be and the same is hereby ap- proved and the assessments so to be levied shall be paid in twenty (20) semi-annual installments, with interest on deferred payments at the same rate as shall be borne by the bonds to be issued in anticipation of the collection thereof, provided that the owner of any property to be assessed may, at his option, pay such assessment in cash within thirty (30) days after the passage of the assessing ordinance. Section 6. That obligations of the City shall be issued, in anticipation of the collection of special assessments by installments and in an amount equal thereto, for the purpose of providing funds to pay the cost of this improvement. Section 7, That the remainder of the entire cost of this im- provement, after application o~ the assessments herein provided shall be paid by the issuance of notes a~d bonds of the City in the manner provided by law. Section 8. That pursuant to Article XIV, Section 16, of the Charter of the City, the Director of Public Works has heretofore certi- fied to this Council that his estimate of the life of the improvement described in Sections 1 and 2 hereof is twenty-five (25) years. Section 9. That the Director of Public Works be and he is hereby authorized and directed as soon as the funds therefor are avail- able to make and execute a contract for said improvement with the lowest and best bidder after advertising according to law. Section 10. That the Clerk of this Council be and she is hereby directed to deliver to the Auditor of Cuyahoga County a certified copy of this ordinance within fifteen (15) days following its passage. 2
