been filed; but if it should be determined that any claims have been <br />filed, they shall be inquired into before the commencement of the proposed <br />improvement, and the Director of Law shall be, and he is hereby authorized <br />and directed to institute legal proceedings in m court of competent juris- <br />diction to inquire into any claims so filed. <br /> <br /> Section 4. That one hundred percent (100%) of the whole cost <br />of said improvement to be borne by the City shall be assessed by the <br />benefits upon all lots and lands bounding and abutting upon the proposed <br />improvement between the termini aforesaid, which said lots and lands are <br />hereby determined to be specially benefited by said improvement; and the <br />cost of said improvement shall include the cost of preliminary and other <br />surveys, plans, specifications, profiles and estimates and of printing, <br />serving and publishing notices, resolutions and ordinances, the amount <br />of damages resulting from the improvement assessed in favor of any owner <br />of land affected by the improvement and the interest thereon, the costs <br />incurred in connection with the preparation, levy and collection of the <br />special assessments, the cost of purchasing, appropriating and otherwise <br />acquiring therefor any required real estate or interests therein, expenses <br />of legal services including obtaining an approving legal opinion, cost <br />of labor and material and interest on bonds and notes issued in anticipa- <br />tion of the levy and collection of the special assessments together with <br />all other necessary expenditures. <br /> <br /> Section 5. That the list of estimated assessments as hereto- <br />fore prepared by the Director of Finance be and the same is hereby ap- <br />proved and the assessments so to be levied shall be paid in twenty (20) <br />semi-annual installments, with interest on deferred payments at the same <br />rate as shall be borne by the bonds to be issued in anticipation of the <br />collection thereof, provided that the owner of any property to be assessed <br />may, at his option, pay such assessment in cash within thirty (30) days <br />after the passage of the assessing ordinance. <br /> <br /> Section 6. That obligations of the City shall be issued, in <br />anticipation of the collection of special assessments by installments <br />and in an amount equal thereto, for the purpose of providing funds to <br />pay the cost of this improvement. <br /> <br /> Section 7, That the remainder of the entire cost of this im- <br />provement, after application o~ the assessments herein provided shall be <br />paid by the issuance of notes a~d bonds of the City in the manner provided <br />by law. <br /> <br /> Section 8. That pursuant to Article XIV, Section 16, of the <br />Charter of the City, the Director of Public Works has heretofore certi- <br />fied to this Council that his estimate of the life of the improvement <br />described in Sections 1 and 2 hereof is twenty-five (25) years. <br /> <br /> Section 9. That the Director of Public Works be and he is <br />hereby authorized and directed as soon as the funds therefor are avail- <br />able to make and execute a contract for said improvement with the lowest <br />and best bidder after advertising according to law. <br /> <br /> Section 10. That the Clerk of this Council be and she is hereby <br />directed to deliver to the Auditor of Cuyahoga County a certified copy of <br />this ordinance within fifteen (15) days following its passage. <br /> <br />2 <br /> <br /> <br />
