ORDINANCE NO: 13-82 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendli~ng AN EMERGENCY ORDINANCE authorizing the City Engineer to advertise for bids and enter into contract with the lowest and best bidder for the demolition and removal of the following components of the Lakewood Incinerator: the scrubber, the electrostatic precipitator, all metallic ducting, and all liner materials inside these components. ICHEREAS, in order to comply with the restrictions in air pollution set by the Environmental PrOtection Agency, it has been necessary to discontinue use of the Lakewood Incinerator, and WHEREAS, the City of Lakewood is now hauling all rubbish directly to landfill, and has no immediate plans to return to any system of rubbish incineration, and WHEREAS, any system for rubbish incineration which might be considered in the future would not utilize any of the metallic components of the existing incinerator system~ and WHEREAS, the aforesaid metallic components of the incinerator system are in an advanced state of deterioration and constitute a hazard to personnel working in the area, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety, and welfare and for the further reason that it is in the interest of the public service, welfare and safety to proceed with the removal of this hazardous equipment at the earliest possible time; now, therefore BE IT ORDAINED 'BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the City Engineer be and he is hereby authorized and directed to advertise for bids end.enter into contract with the lowest and best bidder for the demolition and removal of the following compo- nents of the Lakewood Incinerator: the scrubber, the electrostatic precipitator, all metallic ducting, and all liner materials inside these components° Section 2. That the estimated cost of this demolition work is $50,000, and this sum is hereby appropriated from the Incinerator Site Improvement Fund. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and that all such de- liberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
