ORDINANCE NO: 13-82 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendli~ng <br /> <br /> AN EMERGENCY ORDINANCE authorizing the City Engineer to <br />advertise for bids and enter into contract with the lowest and <br />best bidder for the demolition and removal of the following <br />components of the Lakewood Incinerator: the scrubber, the <br />electrostatic precipitator, all metallic ducting, and all liner <br />materials inside these components. <br /> <br /> ICHEREAS, in order to comply with the restrictions in air <br />pollution set by the Environmental PrOtection Agency, it has been <br />necessary to discontinue use of the Lakewood Incinerator, and <br /> <br /> WHEREAS, the City of Lakewood is now hauling all rubbish <br />directly to landfill, and has no immediate plans to return to any <br />system of rubbish incineration, and <br /> <br /> WHEREAS, any system for rubbish incineration which might <br />be considered in the future would not utilize any of the metallic <br />components of the existing incinerator system~ and <br /> <br /> WHEREAS, the aforesaid metallic components of the incinerator <br />system are in an advanced state of deterioration and constitute a <br />hazard to personnel working in the area, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, <br />safety, and welfare and for the further reason that it is in the <br />interest of the public service, welfare and safety to proceed with <br />the removal of this hazardous equipment at the earliest possible <br />time; now, therefore <br /> <br /> BE IT ORDAINED 'BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That the City Engineer be and he is hereby authorized <br />and directed to advertise for bids end.enter into contract with the lowest <br />and best bidder for the demolition and removal of the following compo- <br />nents of the Lakewood Incinerator: the scrubber, the electrostatic <br />precipitator, all metallic ducting, and all liner materials inside <br />these components° <br /> <br /> Section 2. That the estimated cost of this demolition work is <br />$50,000, and this sum is hereby appropriated from the Incinerator Site <br />Improvement Fund. <br /> <br /> Section 3. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council and that all such de- <br />liberations of this Council and of any of its committees that resulted <br />in such formal action, were in meetings open to the public, in compliance <br />with all legal requirements including Section 121.22 of the Ohio Revised <br />Code. <br /> <br />Section 4.
