Section 4. That the benefited footage of lots on Jackson, Lincoln, <br />Giel, Cove, Lewis and Edgewater shall be assessed at the rate of $5,00 <br />per foot of frontage; that the benefited footage of lots on Davis Court and <br />Reveley Avenue shall be assessed at the rate of $4.50 per foot of frontage and <br />the benefited footage of lots on Lakewood Heights, McKinley Avenue and Alger <br />Road shall not be assessed for this improvement, to ~t: all lots and lands <br />bounding and abutting upon .the proposed improvement between the termini afore- <br />said, which said lots and lands are hereby determined to be specially benefited <br />by said improvements; and the cost of said improvement shall include the cost <br />of .preliminary and other surveys, plans, specifications, profiles and estimates <br />and of printing, serving and publishing notices, resolutions and ordinances, <br />the amount of damages resulting from the improvement assessed in favor of any <br />owner or land affected by the improvement and the interest thereon, the costs <br />incurred in connection with the preparation levy and collection of the special <br />assessments, the cost of purchasing, appropriating, and otherwise acquiring <br />therefor any required real estate or interest therein, expenses of legal <br />service including obtaining and approving legal opinion, cost of labor and <br />material and interest on bonds and notes issued in anticipation of the levy and <br />collection of the special assessments together with all other necessary expendi- <br />tures. <br /> <br /> Section 5. That the list of estimates assessments as heretofore <br /> prepared by the Director.of Finance and included in the report of the Board of <br /> Revision of Assessments be and the same is hereby approved and the assessments <br /> so to be levied shall be paid ten (10) semi-annual installments, with interest <br /> on deferred payments at the same rate as shall be borne by the bonds to be <br /> issued in anticipation of the collection thereof, provided that the oWner of <br /> any property to be assessed may, at his option, pay such assessment in cash <br /> within thirty (30) days after the passage of the assessing ordinance. <br /> <br /> Section 6. That obligations of the City shall be issued, in <br /> anticipation of the collection of special assessments by installments and in an <br /> amount thereto, for the purpose of providing funds to pay the cost of this <br /> improvement. <br /> <br /> Section 7. That the remainder of the entire cost of this improvement, <br /> after application of the assessments herein provided shall be paid by the <br /> issuance of notes and bonds of the City in the manner provided by law. <br /> Section 8. That pursuant to Article XIV, Section 16, of the Charter <br /> of the City, the Director of Public Works has heretofore certified to this <br /> Council that his estimate of the life of the improvement described in Sections <br /> 1 and 2 hereof is ten (10) years. <br /> <br /> Section 9. That the Clerk of Council be and she is hereby directed <br /> to deliver to the Auditor of Cuyahoga County a certified copy of this ordinance <br /> within fifteen (15) days following its passage. <br /> <br /> Section 10. It is found and determined that all formal actions of <br /> this Council concerning and relating to the passage of this Ordinance were <br /> adopted in an open meeting of this Council, and that all such deliberations of <br /> this Council and of any of its committees that resulted in such formal action, <br /> were in meetings open to the public, in compliance with all legal requirements <br /> inclu¢iing Section 121.22 of the Ohio Revised Code. <br /> <br /> Section ll. That this Ordinance is hereby declared to be an <br /> emergency measure for the reasons stated in the preamble hereof and provided it <br /> receives the affirmative vote of two-thirds of all members elected to Council, <br /> it shall take effect and be in force immediately upon its adoption and approval <br /> by the Mayor; otherwise, it shall take effect and be in force after the <br /> earliest period allowed by law. <br /> <br /> Adopted: - ~ ~ <br /> <br />Approved: <br /> ~..i .~i · <br /> <br /> <br />
