ORDINANCE NO. 25-82 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor for and on behalf of the <br />City of Lakewood to accept as a gift to the City of Lakewood, a deed for a <br />small parcel of land situated adjacent to the City owned property on St. <br />Charles Avenue south of Detroit Avenue. <br /> <br /> WHEREAS, Bernard W. Rainer and David R. Bell are the owners of a <br />landlocked parcel of land situated between the metered parking lot on the <br />southeast corner of St. Charles Avenue and Detroit Avenue and Municipal Parking <br />Garage #1 on St. Charles Avenue, and <br /> <br /> WHEREAS, Mr. Rainer and Mr. Bell have expressed a willingness and <br />desire to transfer said parcel of land to the City of Lakewood as a gift, and <br /> WHEREAS, this Council determines that it is in the best interest of <br /> the City to accept such parcel of land, and <br /> WHEREAS, this ordinance constitutes an emergency measure in that the <br /> acceptance of said gift should be consumated at the earliest possi-ble time and <br /> for the immediate preservation of the public welfare; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Mayor be and he is hereby authorized to accept <br /> as a gift to the City of Lakewood, a deed for the following described premises <br /> located south of Detroit Avenue between the City's metered parking lot or the <br /> southwest corner of St. Charles Avenue and Detroit Avenue and Municipal Parking <br /> Garage #1: <br /> <br /> SITUATED in the City of Lakewood, County of Cuyahoga and State <br /> of Ohio and known as being part of Original Rockport Township <br /> Section No. 22, and bounded and described as follows: Begin- <br /> ning at the Southwesterly corner of land conveyed to Harry E. <br /> Siegel and Joseph B, Bloomfield and also known as the Douglas <br /> Industries, Inc., an Ohio Corporation, which point is also 189.96 <br /> feet from the southerly line of Detroit Avenue, 76 feet wide, <br /> measured along the easterly line of St. Charles Avenue, 60 <br /> feet wide, and recorded in Volume 12588, Page 499 of Cuyahoga <br /> County Records; thence Easterly along the Southerly line of <br /> said parcel of a distance of about 22.83 feet to a point which <br /> is the principal place of beginning. Thence Easterly along <br /> the said line a distance of about 32.12 feet to the Easterly <br /> side of the existing two-story brick building which point is <br /> about 5.05 feet Westerly from the Southeasterly corner of said <br /> parcel; thence Southerly a distance of about 3 feet; thence <br /> Westerly to an angle deflecting to the right a distance of <br /> about 32.50 feet to the principal place of beginning, be the <br /> same more or less, but subject to all legal highways. <br /> <br />Permanent Parcel No. 314-04-059. <br /> <br /> Section 2. That the Director of Law ~s hereby authorized and <br />directed to cause said quitclaim deed to be filed and recorded for record with <br />the recorder of Deeds and Records of Cuyahoga County. <br /> <br /> Section 3. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> <br />
