Section 1 hereof from the Hospital Fund upon delivery by the Grantors of <br />a good and sufficient Warranty Deed to the City of Lakewood, together with <br />guarantee of title disclosing the said real estate to be free and clear <br />of all encumbrances excepting taxes and assessments not yet due and payable, <br />zoning ordinances and restrictions of record, if any; and that the Director <br />of Finance be and he is hereby authorized to pay the City's share of <br />expenses incidental to the completion of the purchase, including the cost <br />of the Deed, one-half of the escrow fee and any prorata share chargeable to <br />the City as purchaser. <br /> <br /> Section 3. The cost of the purchase of said property shall be paid <br />from the Hospital fund - plant replacement restricted fund. <br /> <br /> Section 4. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all said deliberations <br />of this Council and that of any of its committees that resulted in such for- <br />mal action, were in meetings open to the public in accordance with all legal <br />requirements including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its adoption and approval <br />by the Mayor, otherwise it shall take effect and be in force from and after <br />the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />Approved: <br /> <br />-2- <br /> <br /> <br />
