ORDINANCE NO: 43-82 BY: Brown, Chinnock, Gallagher, <br /> Graham, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the City Engineer to <br />advertise for bids and enter into a contract with the lowest and <br />best bidder after advertisement according to law for the installa- <br />tion of a water main on Cohassett Avenue between Madison Avenue <br />and Detroit Avenue in the City of Lakewood. <br /> WHEREAS, Council has determined that the water main on <br />Co~assett Avenue between Madison Avenue and Detroit Avenue is <br />badly deteriorated and in urgent need of replacement, and <br /> WHEREAS, this Council has authorized the preparation of <br /> construction drawings and specifications by the Lakewood Engineering <br /> Department, and <br /> WHEREAS, the aforementioned construction drawings and <br /> specifications are now on file in the City Engineer's office, and <br /> I~HEREAS, this Ordinance constitutes an emergency measure <br /> providing for the usual daily operation of a municipal department <br /> and for the immediate preservation of the public safety and wel- <br /> fare; now, therefore <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF I~AKEWOOD, <br /> STATE OF OHIO: <br /> Section 1. That the City Engineer be and he is hereby <br /> authorized and directed to advertise for bids and enter into a <br /> contract with the lowest and best bidder after advertisement <br /> according to law for the installation of a new water main on <br /> Cohassett Avenue between Madison Avenue and Detroit Avenue in <br /> the City of Lakewood. <br /> Section 2. That the cost of such construction is estimated <br /> at $190,000 plus contingencies in the amount of $30,000, which funds <br /> are to be made available from the Water Fund as a result of a note <br /> issued° <br /> Section 3~ It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of <br /> this ordinance were adopted in an open meeting of this Council, <br /> and that all such deliberations of this Council and of any of its <br /> committees that resulted in such formal action, were in meetings <br /> open to the public, in compliance with all legal requirements <br /> including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this Ordinance is hereby declared to be <br /> an emergency measure for the reasons stated in the preamble hereof <br /> and provided it receives the affizmative vote of two-thirds of all <br /> members elected to Council, it shall take effect and be in force <br /> immediately upon its adoption and approval by the Mayor; otherwise <br /> it shall take effect and be in force after the earliest period <br /> allowed by law. <br /> <br />Vice- President <br /> <br />Clerk <br /> <br /> <br />
