ORDINANCE NO. 48-82 <br /> <br />BY: Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> <br />AN EMERGENCY ORDINANCE creating the Sidewalk Repair Special Assess- <br />ment Fund and transferring and additionally appropriating funds <br />thereto, <br />WHEREAS, it was the determination of the Administration and this <br />Council during the Appropriations Hearings that a sidewalk repair <br />program is necessary, and <br /> <br />WHEREAS, a backlog of sidewalks to be repaired has been generated <br />in the Public Works Department, and <br />WHEREAS, THE City has appropriated $25,000 from its Community Devel- <br />opment Block Grant Funds for such a program, and <br /> <br /> WHEREAS, it is anticipated that approximately $75,000 be gained <br /> from Special Assessment Notes to be sold at a later date; now, <br /> therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, CUYAHOGA COUNTY, OHIO: <br /> Section 1. The Sidewalk Repair Special Assessment Fund now and <br /> is hereby created in the Special Assessment Fund section of the <br /> City's Chart of Accounts. <br /> <br /> Section 2. That the sum of $25,000 hereby appropriated from the <br /> Community Development Fund be transferred into the Sidewalk Special <br /> Assessment Fund for use in sidewalk maintenance and is hereby <br /> appropriated. <br /> <br /> Section 3. That the proceeds of the note to be sold later be <br /> placed in the Sidewalk Special Assessment Fund. <br /> Section 4. It is found and determined that all formal actions of <br /> this Council concerning and relating to the passage of this or- <br /> dinance were adopted in an open meeting of this Council, and that <br /> all such deliberations of this Council and of any of its committees <br /> that resulted in such formal action, were in meetings open to the <br /> public, in compliance with all legal requirements including Section <br /> 12t.22 of the Ohio Revised Code. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided <br /> it receives the affirmative vote of two-thirds of all members <br /> elected to Council, it shall take effect and be in force immed- <br /> iately upon its adoption and approval by the Mayor; otherwise, <br /> it shall take effect and be in force after the earliest period <br /> allowed by law. <br /> <br />Adopted: <br /> <br />Approved:~m~L /q l~ ~-,~..., <br /> <br /> <br />
