ORDINANCE NO. 49-82 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMREGENCY ORDINANCE authorizing the Mayor to enter into a Purchase <br />Agreement ,with the Board of Education of the Lakewood City School District with <br />an option for the repurchase of said property ten years and one day after said <br />purchase. <br /> <br /> WHEREAS, The City of Lakewood has made application to HUD for monies <br />for the construction of a neighborhood recreational facility,and <br /> <br /> WHEREAS, pursuant to the provisions of said application, the City <br />must own the property wherein such a neighborhood facility is constructed, and <br /> <br /> WHEREAS, the Board of Education of the Lakewood City Schools has <br />property which is situated and appropriate for the construction of a neighbor- <br />hood facility, and <br /> <br /> WHEREAS, the City of Lakewood must own said property for a term of no <br />less than ten years, it is therefore determined that it is in the best interest <br />of the City and its citizens that a contract be entered into for the purchase <br />in substantially the form attached as Exhibit "A" hereto. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public health and welfare and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> · Section 1. That the Mayor be and he is hereby authorized and <br />directed to enter into a Purchase Agreement with the Board of Education of the <br />Lakewood City School District with an option for repurchase of said property <br />ten years and one day after said purchase. Said Agreement to be in substantial- <br />ly the form attached hereto an Exhibit "A" <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this Ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and of any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements <br />including Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stat'ed in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest <br />period allowed by law. <br /> <br />Adopted: <br /> <br />Appr°ved:~-~_Ol i ~ F,~ <br /> <br /> <br />
