Section 4. That one hundred percent (100%) of the whole cost <br />of said improvement to be borne by the City shall be assessed by the <br />benefits upon all lots and lands bounding and abutting upon the proposed <br />improvement between the termini aforesaid, which said lots and lands are <br />hereby determined to be specially benefited by said improvement; and the <br />cost of said improvement shall include the cost of preliminary and other <br />surveys, plans, specifications, profiles an~ estimates and of printing, <br />serving and publishing notices, resolutions and ordinances, the amount <br />of damages resulting from the improvement assessed in favor of any owner <br />of land affected by the improvement and the interest thereon, the costs <br />incurred in connection with the preparation, levy and collection of the <br />special assessments, the cost of purchasing, appropriating an4otherwise <br />acquiring therefor any required real estate or interests therein, expenses <br />of legal services including obtaining an approving legal opinion, cost <br />of labor and material and interest on bonds and n~tes issued in anticipa- <br />tion of the levy and collection of the special assessments together with <br />all other necessary expenditures. <br /> <br /> Section 5. That the list of estimated assessments as hereto- <br />fore prepared by the Director of Finance and included in the report of <br />the Board of Revision of Assessments be and the same is hereby approved <br />and the assessments so to be levied shall be paid in twenty (20) semi- <br />annual installments, with interest on deferred payments at the same rate <br />as shall be borne by the bonds to be issued in anticipation of the collec- <br />tion thereof, provided that the owner of any property to be assessed may, <br />at his option, pay such assessment in cash within thirty (30) days after <br />the passage of the assessing ordinance. <br /> <br /> Section 6. That obligations of the City shall be issued, in <br />anticipation of the collection of special assessments by installments <br />and in an amount equal thereto, for the purpose of providing funds to <br />pay the cost of this improvement. <br /> <br /> Section 7. That pursuant to Article XIV, Section 16, of the <br />Charter of the City, the Director of Public Works has heretofore certi- <br />fied to this Council that his estimate of the life of the improvement <br />described in Sections 1 and 2 hereof is twenty-five (25) years. <br /> <br /> Section 8. That the Director of Public Works be and he is <br />hereby authorized and directed as soon as the funds therefor are avail- <br />able to make and execute a contract for said improvement with the lowest <br />and best bidder after advertising according to law. <br /> <br /> Section 9. That the Clerk of this Council be and she is hereby <br />directed to deliver to the Auditor of Cuyahoga County a certified copy <br />of this ordinance within fifteen (15) days following its passage. <br /> <br /> Section 10. That it is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ocdinance were adopted in an open meeting of this Council, and that all <br />such deliberations of this Council and of any of its committees that <br />resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements including Section 121.22 of the <br />Ohio Revised Code° <br /> <br />-2- <br /> <br /> <br />
