ORDINANCE NO.: 54-82 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br />AN EMERGENCY ORDINANCE to amend Section 903.03 of the Streets, <br />Utilities, & Public Services Code of the City of Lakewood. <br /> <br /> WHEREAS, the sidewalk on Clifton Boulevard are in a very bad <br />condition due in a large part to damage caused by roots of trees <br />along the sidewalks, and, <br /> <br /> WHEREAS, it would be in the best interest of the City to reduce <br />the required width of .sidewalks on Clifton Blvd. from six feet to <br />five feet to allow for growth of trees close to the existing <br />sidewalks which are causing the damage, and, <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the immediate preservation of the public safety, and welfare and <br />for the usual daily operation of a municipal department; now, therefore <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 903.03 of the Streets, Util%ties <br />Public Services Code of the Codified Ordinances of the City of <br />Lakewood now reading as follows: <br /> <br />903.03 SIDEWALK WIDTHS <br /> <br />On all streets and alleys of not less than thirty- <br />three or more than forty feet in width, the sidewalks <br />shall be not less than four feet wide. On all streets <br />not less than forty nor more than sixty feet in width, <br />all sidewalks shall be not less than five feet wide. <br /> <br />On all streets more than sixty feet wide and on all <br />main streets or east and west thoroughfares, all side- <br />walks shall be not less than six feet wide. However, <br />on any street which is not a main street or an east <br />and west thoroughfare, but is nevertheless devoted <br />entirely to residences, the sidewalks shall be not <br />less than five feet wide. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />903.03 SIDEWALK WIDTHS <br /> <br />On all streets and alleys of not less than thirty- <br />three or more than forty feet in width, the sidewalks <br />shall be not less than four feet wide. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this Ordin- <br />ance were adopted in an open meeting of this Council, and that all <br />such deliberations of this Council and of any of its committees that <br />resulted in such formal action, were in meetings open to the public, <br />in compliance with all legal requirements including Section 121.22 of <br />the Ohio Revised Code. <br /> <br /> <br />
