ORDINANCE NO. 55-82 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN ORDINANCE §~ :~C to Complexicable, Inc., an Ohio corporation, <br />the non-exclusive right to -~ct, maintain and operate in, under, above, along, <br />across and upon the streets, lanes, avenues, sidewalks, alleys and highways and <br />other public places of '~he City of Lakewood, Ohio, for the purpose of <br />transmission and distributSon of television signals to enable the sale of its <br />service to the inhabitants of seven high-rise apartment complexes situated in <br />the City and other purposes, for a period of 15 years and regulating the same. <br /> <br /> WHEREAS, an appi'cation has been received from Complexicable, Inc., <br />an Ohio corporation for a limited non-exclusive franchise which would permit <br />the company to interconnect seven high-rise apartment complexes with which it <br />has long term service contracts intoa single intregrated system, and <br /> <br /> WHEREAS, said applicant must, of necessity, use the streets and <br />highways of the City of Lakewood for the purpose of installing its system, and <br /> <br /> WHEREAS, it is necessary that some regulation over said installation <br />be promulgated; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. In consideration of the faithful performance and observ- <br />ance of the conditions and reservations hereinafter specified a limited non- <br />exclusive right is hereby granted to Complexicable, Inc., a corporation organiZ- <br />ed under the laws of the State of Ohio, its successors or assigns (hereinafter <br />referred to as the "Company") to erect, maintain, operate and utilize television <br />transmission and distribution facilities and additions thereto in, under, <br />above, along, across, and upon the streets, lanes, avenues, sidewalks, alleys <br />and other public places in the City of Lakewood and subsequent additions <br />thereto, for the purpose of transmission and distribution of audio and visual <br />impulses and televisions energy in accordance with the laws and regulations of <br />the United States of America and the State of Ohio, and the ordinances and <br />regula'~ions of the City of Lakewood for a period of fifteen (15! years ~o the <br />follo~,lng seven high-rise apartment complexes: <br /> <br /> The Carlyle <br /> Marine Towers East and West <br /> Imperial House <br /> Lake House <br /> Edgewater Towers <br /> The Envoy House <br />(collectively referred to herein as the "Lakewood System") <br /> <br /> Section 2. Wherever used in this Ordinance, the word "television" <br />shall mean a system for transmission of audio signals and/or visual or any <br />other type of closed circuit transmission and/or signal transmission by means <br />of electrical impulses. <br /> <br /> Section 3. It is contemplated that the Company will make arrangements <br />with the Ohio Bell Telephone Company, the Cleveland Electric Illuminating <br />Company or any other holder of licenses or franchises from the City for the <br />purposes of using the towers, poles, and attachments thereto of said companies <br />for the attachment of television transmission and distribution facilities, <br />subject to all existing and future ordinances of the City. <br /> <br /> Section 4. The Company will not erect a separate system of poles in <br />the City or on any street therein, but may erect poles where shown to be <br />necessary when the necessity, the location, and the style of poles have been <br />approved by the Director of Public Works and the Mayor of the City, which <br />approval will not be u.n~asonably withheld. The erection of poles shall be <br />subject to all existing and future ordinances and regulations of the City <br />applicable 'thereto and under the supervision of the Director of Public Works. <br /> <br /> <br />
