An informal complaint shall be submitted to the Mayor in writing and <br />shall contain: (1) the name and address of the complainant; (2) the name of the <br />cable system against which the complaint is made; and (3) complete statement of <br />facts upon which the complaint is based. <br /> <br />(a) <br /> <br />Upon receipt of any informal complaint, the Mayor will forward <br />a copy to the system complaintd of or may take the question up <br />by correspondence with the system. Within such time as may be <br />prescribed by the Mayor, the system will be called upon to satisfy <br />the complaint or advise the Mayor of its refusal or inability to <br />do so. If the system satisfies the complaint, it shall so notify <br />the Mayor in accordance with the provisions of Subparagraph (c) <br />hereof. The Mayor will forward a copy of the system's notice of <br />satisfaction to the complainant. If the system refuses or is un- <br />able to satisfy the complaint, it shall so notify the Mayor, and <br />the Mayor will forward a copy of such notice to the complainant, <br />with a statement of the procedure to be followed to further pro- <br />secute the complaint. <br /> <br />(b) <br /> <br />If a system satisfies any complaint brought to its attention by <br />the Mayor, a statement must be filed with the Mayor setting forth <br />when and how the complainant has been satisfied. <br /> <br />(c) When a complaint has not been satisfied pursuant to Subparagraph <br /> (b) hereof, the complainant may file a formal complaint with the <br /> City Council in the form and manner to be specified thereby. The <br /> complaint to the City Council must be filed with six months from <br /> the date of the Mayor's statement accompanying a copy of the <br /> system's notice of refusal or inability to satisfy the complaint, <br /> and the complaint to the City Council must make reference to the <br /> date of the complaint filed with the Mayor and that it is based <br /> on the same facts as the complaint filed with the Mayor. If no <br /> complaint is filed with the City Council within the six months <br /> period, the complainant will be deemed to have abandoned his com- <br /> plaint, and such complaint will be deemed dismissed. <br /> <br />(d) <br /> <br />Notice of the foregoing procedures for reporting and resolving <br />complaints will be given to each subscriber by the franchise at <br />the time of initial subscription to the cable system. <br /> <br /> Section 17. During the term of this franchise, and any renewal thereof <br />the Company shall maintain within the City a local business office and a govern- <br />ment access studio. The provisions of this Section shall be complied with if <br />Company maintains a local business headquarters office and the government access <br />studio within 10 airline miles of the center of the City; provides the City's <br />Mayor.'s office with the name, address'and phone number of a resident of the City <br />who will act as Company's agent to receive complaints regarding quality of <br />service, equipment malfunctions and similar matters, and at least once a week <br />informs all subscribers by appropriate announcement (e.g., by a slide card) over <br />the systems originations cable-casting channel of the name, address and phone <br />number of the Company's registered agent for the City. <br /> <br /> Section 18. Consistent with the requirements of Rule 76.31 of the FCC, <br />any modification of Rule 76.31 resulting from amendment thereto by the FCC shall <br />to the extent applicable, be considered as a part of this franchise as of the <br />effective date of the amendment made by the FCC and shall be incorporated to such <br />franchise by specific amendments thereto by the lawful action of the City Council <br />within one year from the effective date of the FCC's amendment or at the time <br />of reneal of this franchise, whichever occurs first. <br /> <br /> Section 19. The rights and privileges herein granted shall not be <br />assignable or transferable in any bankruptcy proceedings, trusteeship, receiver- <br />ship, orby operation of any law, in any of which events this franchise shall <br />terminate forthwith, nor shall said Company sell, lease, assign or otherwise <br />alienate this franchise or any privilege hereunder without the prior approval <br />of Council and subject to the terms and conditions as Council may provide. <br /> <br /> <br />
