ORDINANCE NO. 56-82 BY: <br /> <br />Brown, Chinnock., Gallagher, Graham, <br />McBride, Salmon, Wendling <br /> <br />AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement <br />with the Ohio Department of Natural Resources to accept one-third grant <br />for a private breakwall (not to exceed $70,000) for the preventing, <br />correcting and arresting of lake shore erosion. (Waterford Breakwall Project) <br /> <br />WHEREAS, that pursuant to Resolution No. 5696, Lakewood City Council did <br />authorize the Mayor to make application for said funds to benefit certain <br />Lakewood property owners, and <br /> <br />WHEREAS, said Waterford Condominium property owners have petitioned the City <br />to act with the State, for the purpose of constructing a precast concrete <br />breakwall along the shoreline for protection of their properties from ero- <br />sion, and <br /> <br />WHEREAS, funds for the State's share of the construction costs are available <br />in the State Treasury, special account, and <br /> <br />WHEREAS, this Ordinance constitutes an emergency measure in that'it provides <br />for the immediate preservation of the public health, safety and welfare; and <br />for the further reason that this ordinance must be immediately effective to <br />prevent the erosion of properties within the City which could endanger the <br />health and safety of residents of the City by severing water mains and <br />sewers, collapsing houses and blocking streets, now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Mayor be and he is hereby authorized and directed to <br />enter into an agreement with the Ohio Department of Natural Resources to <br />accept a grant for one-third of the cost of the construction of a breakwall <br />(not to exceed $70,000) for the preventing, correcting and arresting of lake <br />shore erosion along certain shoreline of Lake Erie, designated as Waterford <br />Breakwall Project. Such agreement shall be substantially in the form attached <br />hereto as Exhibit A. <br /> <br />Section 2. That this ordinance i?s hereby declared to be an emergency measure <br />and provided it receives the affirmative vote of two-thirds of all members <br />elected to council, it shall take effect and be in force immediately upon its <br />adoption and approved by the Mayor. ~~~ <br /> <br />Approved.~ /~ / ~Y~---- <br /> <br /> <br />
