ORDINANCE N0.72-82 BY: Brown, Chinnock, Gallagher, Graham, McBride, Wendling AN EMERGENCY ORDINANCE authorizing and directing the Director of Public Works to enter into a contract for the purchase of a Vac Master Leaf Unit and Hopper from A. S. Gilbert, Inc. without competitive bidding. WHEREAS, a real and present emergency has arisen in connection with the operation and maintenance of the Department of Public Works in that present equipment is not adequate to handle the leaf collection program of the City which program is scheduled to be initiated in the immediate future and, WHEREAS, A. S. Gilbert, Inc., of Kingston, New Jersey, has avail- able for sale a 1962 Vac Master Leaf Unit and Hopper which has only been used a few times for demonstration, which unit is avail- able for the sum of $9,825.00, f.o.b. Lakewood, and WHEREAS, since these Vac Master Leaf Units and Hoppers are diffi- cult to locate and it is in the best interest of the City that the aforementioned unit be purchased forthwith, and, WHEREAS, pursuant to authority of Ohio Revised Code 735.051 the City may purchase equipment for the Department of Public Works in the case of a real and present emergency which this Council hereby declares to exist, and WHEREAS, this ordinance constitutes and emergency measure providing for the immediate preservation of the public healths safety and welfare and for the usual daily operation of a municipal department; now, therefore: BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Public Works be and he is hereby authorized and directed to purchase from A. S. Gilbert, Inc., P.O. Box 338, Kingston, New Jersey, a 1962 Vac Master Leaf Unit and Hopper, f.o.b. Lakewood, for the sum of $9,825.00 without compet- itive bidding. Section 2. The cost for the aforementioned Vac Master Leaf unit and Hopper shall be appropriated from the unexpended balance of the Federal Revenue Sharing Fund. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council ~nd of any of its com- mittees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 4. That this ordinance is hereby declared to be an emer- gency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor. ~/' ' ' I; lerk Appr°Ved :~7~~="~ ~
