ORDINANCE N0.72-82 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Wendling <br /> <br />AN EMERGENCY ORDINANCE authorizing and directing the Director <br />of Public Works to enter into a contract for the purchase of a <br />Vac Master Leaf Unit and Hopper from A. S. Gilbert, Inc. without <br />competitive bidding. <br /> <br />WHEREAS, a real and present emergency has arisen in connection <br />with the operation and maintenance of the Department of Public <br />Works in that present equipment is not adequate to handle the leaf <br />collection program of the City which program is scheduled to be <br />initiated in the immediate future and, <br /> <br />WHEREAS, A. S. Gilbert, Inc., of Kingston, New Jersey, has avail- <br />able for sale a 1962 Vac Master Leaf Unit and Hopper which has <br />only been used a few times for demonstration, which unit is avail- <br />able for the sum of $9,825.00, f.o.b. Lakewood, and <br /> <br />WHEREAS, since these Vac Master Leaf Units and Hoppers are diffi- <br />cult to locate and it is in the best interest of the City that <br />the aforementioned unit be purchased forthwith, and, <br /> <br />WHEREAS, pursuant to authority of Ohio Revised Code 735.051 the <br />City may purchase equipment for the Department of Public Works <br />in the case of a real and present emergency which this Council <br />hereby declares to exist, and <br /> <br />WHEREAS, this ordinance constitutes and emergency measure providing <br />for the immediate preservation of the public healths safety and <br />welfare and for the usual daily operation of a municipal department; <br />now, therefore: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO: <br /> <br />Section 1. That the Director of Public Works be and he is hereby <br />authorized and directed to purchase from A. S. Gilbert, Inc., P.O. <br />Box 338, Kingston, New Jersey, a 1962 Vac Master Leaf Unit and <br />Hopper, f.o.b. Lakewood, for the sum of $9,825.00 without compet- <br />itive bidding. <br /> <br />Section 2. The cost for the aforementioned Vac Master Leaf unit <br />and Hopper shall be appropriated from the unexpended balance of <br />the Federal Revenue Sharing Fund. <br /> <br />Section 3. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council ~nd of any of its com- <br />mittees that resulted in such formal action, were in meetings open <br />to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br />Section 4. That this ordinance is hereby declared to be an emer- <br />gency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor. <br /> <br /> ~/' ' ' I; lerk <br />Appr°Ved :~7~~="~ ~ <br /> <br /> <br />
