Section 3. That Section 529.07 of the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />529.07 OPEN CONTAINER PROHIBITED. <br /> <br />(a) No person shall have in his possession an opened container <br />of intoxicating liquor in a State liquor store, or on the premises <br />of the holder of any permit issued by the Department of Liquor <br />Control, or in any other public place. This section does not <br />apply to intoxicating liquor which has been lawfully purchased <br />for consumption on the premises where bought of a holder of an <br />A-l-A, A-2, D-2, D-3, D-3a, D-4, D-5 or a D-5a permit. This <br />section does not apply to liquor consumed on the premises on a <br />convention facility as provided in Ohio R.C. 4303.201. <br />(ORC 4301.62) <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />529.07 OPEN CONTAINER PROHIBITED. <br /> <br />(a) No person shall have in his possession an opened container of <br />beer or intoxicating liquor in a State liquor store, or on the premises <br />of the holder of any permit issued by the Department of Liquor <br />Control, or in any other public place. This section does not <br />apply to beer or intoxicating liquor which has been lawfully <br />purchased for consumption on the premises where bought of a <br />holder of an A-l, A-2, D-l, D-2, D-3, D-3a, D-4, D-5, and D-5a, <br />D-5b, D-7, E, F, and F-2 permit. This Section does not apply <br />to beer or intoxicating liquor consumed on the premises of a con- <br />vention facility as provided in Section 4303.201 of the Revised <br />Code.(ORC 4301.62) <br /> <br /> Section 4, It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal actions, were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law and existing Sections 529.01, 529.02 and 529.07 shall be and the <br />same are hereby repealed. <br /> <br />Approved .'~~ <br /> <br />C~RK ' ~ - <br /> <br /> <br />
