ORDINANCE NQ.80-82 By:Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement <br />with the Ohio Department of Natural Resources to accept a grant in an amount not <br />to exceed $726,000 for the construction of a public breakwall for the preventing, <br />correcting, and arresting of lakeshore erosion (Lakewood Park Breakwall Project). <br /> <br /> WHEREAS, the City of ~Lakewood is the owner of property located on Lake <br /> Erie known as Lakewood Park where it is proposed to construct a breakwall to <br />arrest shore erosion along the Lakewood Park shoreline, and <br /> <br /> WHEREAS, the Mayor,-pursuant to prior authorization, made application <br />for State funds and pursuant to amended Substitute House Bill No. 552, the ll4th <br />General Assembly has appropriated funds for the Lakewood Park Breakwall Project, <br />and <br /> <br /> WHEREAS, it is in the best interest of public health, safety, and <br />welfare for the construction of said project to be undertaken jointly by the <br />State of Ohio and the City of Lakewood which cooperative effort is authorized <br />pursuant to Ohio Revised Code, Section 1501.02~ and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure in that it <br />provides for the immediate preservation of the public health, safety, and <br />welfare; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to enter into an agreement with the Ohio Department of Natural Resources to <br />accept a grant in an amount not to exceed $726,000 for the construction of a <br />public breakwall for the preventing, correcting, and arresting of lakeshore <br />erosion along certain shoreline of Lake Erie, designated as Lakewood Park <br />Breakwall Project. Such agreement shall be substantially in the form attached <br />hereto as Exhibit "A". <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council conerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Dhio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immedately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in force after the earliest period allowed <br />by law. <br /> <br /> <br />
