ORDINANCE NO. 84-82 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement <br />with the Ohio Department of Natural Resources to accept a one-third grant for a <br />private breakwall in an amount not to exceed $52,000 for the preventing, <br />correction and arresting of lake shore erosion. (Lakewood Breakwall Project #4) <br /> <br /> WHEREAS, that pursuant to Resolution No. 5696, Lakewood City Council <br />did authorize the Mayor to make application for said funds to benefit certain <br />Lakewood property owners, and. <br /> <br /> WHEREAS, said certain property owners have petitioned the City to act <br />with the State, for the purpose of constructing a precast concrete breakwall <br />along the shoreline for protection of their properties from erosion, and <br /> <br /> WHEREAS, funds for the State's share of the construction costs are <br />available in the State Treasury, special account, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure in that it <br />provides for the immediate preservation of the p~blic health, safety, and <br />welfare, and for the further reason that this ordinance must be immediately <br />effective to' prevent the erosion of properties within the City which could <br />endanger the health, safety and welfare; and for the further reason that this <br />ordinance must be immediately effective to prevent the erosion of properties <br />within the City which could endanger the health and safety of residents of the <br />City by severing water mains and sewers, collapsing houses and blocking streets; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO; <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to enter into an agreement with the Ohio Department of Natural Resources to accept <br />a grant for one-third of the cost of the construction of a breakwall in an <br />amount not to exceed $52,000 for the preventing, correcting and arresti'ng of <br />lake shore erosion along certain shoreline of Lake Erie, designated as Lakewood <br />Breakwall Project #4. Such agreement shall be substantially in the form <br />attached hereto as Exhibit "A." <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal actions, were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />Adopted: <br /> <br />Approved :~ //~/~'/~ <br /> <br /> <br />
