88-82 Amend portions of 1305.521 & 1603.55 - Housing - liens

1603.55 REPAIR OR DEMOLITION. Upon enactment of said said resolution by City Council, service of said resolution shall be given in accordance with Section 1603.52, to the holders of legal and equitable liens of record upon the real property on which the structure or appertenant structure is located and to the owners of record of such property and if the owner or person in control of the structure fails, neglects or refuses within forty-five (45) days of said service to comply with the decision and order of the Board, as confirmed by City Council, the City acting through the Building Commissioner shall cause said structure to be repaired or demolished in accordance with the decision and order of the Board as confirmed by City Council. Section 4. It is found and determined that all formal actions of this Council conernin9 and relatin§ to the passage of this ordinance were adopted in an open meeting of this Council, and that all such ~eliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code. Section 3. That this ordinance ~s hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immedately upon its adoption and approval by the Mayor; otherwise it shall take effect and be in force after the earliest period allowed by law and existing paragraphs (j) and (k) of Section 1305.521 and existing paragraph (d) of Section 1603,541 and Section 1603.55 of Division D of the Regional Building Code of the Codified Ordinances of the City of Lakewood shall be and the same are hereby repealed at such time.
