ORDINANCE NO. 92-82 <br /> <br />BY: Brown, Gallagher, Graham, McBride, <br /> Salmon, wenlaing~ <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor to enter into an agreement <br />with the Cuyahoga County Regional Plannin§ Commission to conduct a condominium <br />impact study for the City of Lakewood. <br /> <br /> WHEREAS, this Council hereby determines that it is in the best <br />interest of the City to have a condominium impact study made for the City, and <br /> <br /> WHEREAS, the Cuyahoga County Regional Planning Commission is willing <br />and capable of preparin§ such condominium impact study, and <br /> <br /> WHEREAS, this Council determines that such condominium impact study <br />for the Gold Coast area should be available prior to the adoption of the <br />proposed new zoning code now under Consideration by Council, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety, and welfare and for the <br />further reason that the condominium impact study should be obtained at the <br />earliest possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to enter into an agreement with the Cuyahoga County Regional Planning Commissign <br />to prepare a condominium impact study for the City of Lakewood at a cost not to <br />exceed $5,400 for services set forth in the work program attached to the <br />Agreement which Agreement is attached hereto as Exhibit "A" and made a part hereof. <br /> <br /> Section 2. That the cost of said study shall be paid from the <br />unappropriated balance of the General Fund - Legislative Professional Services. <br /> <br /> Section 3. It is found and determined that alt formal actions of this <br />Council concerning and relatin9 to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in force after the earliest period allowed <br />by law. <br /> <br />Adopted: ~--~~/~,/q~'~ <br /> I <br /> <br />~LERK <br /> <br />/~AYOR ~ ~ <br /> <br /> <br />
