ORDINANCE NO. 95-82 <br /> <br />BY: Brown, Gallagher, Graham, McBride, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor ex-officio <br />Director of Public Safety to enter into a contract or contracts for the sale of <br />one 1954 American La France 85 foot aerial ladder truck and miscellaneous <br />equipment for the Division of Fire, Department of Public Safety. <br /> <br /> WHEREAS, Ohio Revised Code Section 721.01 provides that municipal <br />corporations have special power to sell personal property and Ohio Revised Code <br />Section 721.15 further provides that personal property not needed for municipal <br />purposes may be sold when authorized by ordinance of the legislative authority, <br />and <br /> <br /> WHEREAS, the 1954 American La France 85 foot aerial ladder truck, <br />model 4-85J, together with ground ladders and miscellaneous equipment have been <br />replaced with new equipment, is no longer needed for municipal purposes and <br />should be sold, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public safety and welfare and for the usual <br />daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. This Council hereby determines that the 1954 American La <br />France 85 foot aerial ladder truck of the Division of Fire has been replaced by <br />new equipment and is no longer needed for municipal purposes. <br /> <br /> Section 2. That the Mayor ex-officio Director of the Department of <br />Public Safety be and he is hereby authorized and directed to enter into a <br />contract or contracts for the sale of one (1) 1954 American La France 85 foot <br />aerial ladder truck, model 4-85J including ground ladders and miscellaneous <br />equipment with the highest and best bidder or bidders after advertisement <br />according to law for a price not less than $23,000. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor; <br />otherwise it shall take effect and be in force after the earliest period allowed <br />by law. <br /> <br />Approved :~~/~_ <br /> <br />(7~LERK <br /> <br /> <br />
