ORDINANCE NO. 99-82 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE to amend Section 135.05 of the Administrative Code of the Codified Ordinances of the City of Lakewood to increase the maximum number of authorized traffic guards from twenty-five (25) to thirty (30). WHEREAS, the Police Department has completed an in-depth traffic study of three intersections used by children of elementary school age, and WHEREAS, the result of said study is the recommendation to place school traffic guards at the intersection of Warren Road and Madison Avenue and at Bunts Road and Madison Avenue which will necessitate the hiring of additional school traffic guards, and WHEREAS, this Council has determined that it is in the best interest of the City to provide for the hiring of additional school traffic guards, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public safety and welfare, and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 135.05 of the Administrative Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 135.05 TRAFFIC GUARDS. The Mayor, as Director of Public Safety, is hereby authorized to employ not more than twenty-five traffic guards to relieve or replace regular police officers at school crossings, pos- sessing such qualifications as the Director of Public Safety may require. Traffic guards shall not be regarded as regular members of the Division of Police, empowered with the authority or duties of regular police officers, and shall not participate in any of the benefits of the Division of Police. Traffic guards shall be under the direction of the Director of Public Safety and the Chief of Police. shall be and the same is hereby amended to read as follows: 135.05 TRAFFIC GUARDS. Traffic guards shall be under the direction of the Director of Public Safety and the Chief of Police. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
