ORDINANCE NO. 99-82 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 135.05 of the Administrative <br />Code of the Codified Ordinances of the City of Lakewood to increase the maximum <br />number of authorized traffic guards from twenty-five (25) to thirty (30). <br /> <br /> WHEREAS, the Police Department has completed an in-depth traffic study <br />of three intersections used by children of elementary school age, and <br /> <br /> WHEREAS, the result of said study is the recommendation to place <br />school traffic guards at the intersection of Warren Road and Madison Avenue and <br />at Bunts Road and Madison Avenue which will necessitate the hiring of additional <br />school traffic guards, and <br /> <br /> WHEREAS, this Council has determined that it is in the best interest <br />of the City to provide for the hiring of additional school traffic guards, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for <br />the immediate preservation of the public safety and welfare, and for the usual <br />daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 135.05 of the Administrative Code of the <br />Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />135.05 TRAFFIC GUARDS. <br /> <br />The Mayor, as Director of Public Safety, is hereby authorized <br />to employ not more than twenty-five traffic guards to relieve <br />or replace regular police officers at school crossings, pos- <br />sessing such qualifications as the Director of Public Safety <br />may require. Traffic guards shall not be regarded as regular <br />members of the Division of Police, empowered with the authority <br />or duties of regular police officers, and shall not participate <br />in any of the benefits of the Division of Police. Traffic <br />guards shall be under the direction of the Director of Public <br />Safety and the Chief of Police. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />135.05 TRAFFIC GUARDS. <br /> <br />The Mayor, as Director or Public Safety, is hereby authorized <br />to employ not more than thirty (30) traffic guards to relieve <br />or replace regular police officers at school crossings, pos- <br />sessing such qualifications as the Director of Public Safety <br />may require. Traffic guards shall not be regarded as regular <br />members of the Division of Police nor empowered with the <br />authority or duties of regular police officers, and shall not <br />participate in any of the benefits of the Division of Police. <br />Traffic guards shall be under the direction of the Director of <br />Public Safety and the Chief of Police. <br /> <br /> Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action were in <br />meetings open to the public, in compliance with all legal requirements including <br />Section 121.22 of the Ohio Revised Code. <br /> <br /> <br />
