ORDINANCE NO. 4-83 BY: <br /> <br />Brown, Chinnock, Gallagher, Graham, <br />McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY DRDINANCE to amend certain Sections of the General Offenses <br />Code of the Codified Ordinances of the City of Lakewood to comply with current <br />State law. <br /> <br /> WHEREAS, Am. Sub. Senate Bill lg9 and Am. Sub. House Bill 269 have <br />increased from one hundred and fifty dollars ($150.00) to three hundred dollars <br />($300.00) the value of affected property or services involved in determining <br />whether certain offenses are felonies or misdemeanors, or misdemeanors of the <br />first or second degree~ effective January 5, 1983, and <br /> <br /> WHEREAS, the Ohio Constitution requries ordinances which are enacted <br />as an exercise of the Municipality's police powers to comply with general state <br />law, and <br /> <br /> WHEREAS, this ordinance constitutes an emergeny measure providing for <br />the immediate preservation of the public health, safety, and welfare and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 505.05 of the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />505.05 KILLING OR INJURING ANIMALS. <br /> <br />(a) No person shall maliciously, or willfully, and without the <br />consent of the owner, kill or injure a farm animal, dog, cat <br />or other domestic animal that is the property of another. This <br />section does not apply to a licensed veterinarian acting in an <br />official capacity. <br /> <br />(b) Whoever violates this section, if the value of the animal <br />killed or the injury done amounts to less than one hundred fifty <br />($150.00), is guilty of a misdemeanor of the second degree; if <br />the value of the animal killed or the injury done amounts to <br />one hundred fifty dollars ($150.00) or more, such person is <br />guilty of a misdemeanor of the first degree. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />505.05 KILLING OR INJURING ANIMALS. <br /> <br />(a) No person shall maliciously, or willfully, and without the <br />consent of the owner, kill or injure a farm animal, dog, cat or <br />other domestic animal that is the property of another. (ORC 959.02) <br /> <br />Section 2. <br />Ordinances <br /> <br />{b) Whoever violates this section, if the value of the animal <br />is killed or the injury done amounts to less than three hundred <br />dollars ($300.00), is guilty of a misdemeanor of the second <br />degree; if the value of the animal killed or the injury done <br />amounts to three hundred ($300.00) or more, such person is guilty <br />of a misdemeanor of the first degree. (ORC 959.99(B)) <br /> <br /> That Section 517.05 of the General Offenses Code of the Codified <br /> of the City of Lakewood, now reading as follows: <br /> <br />5t7.05 CHEATING. <br /> <br />(a) No person, with purpose to defraud or knowing that he is <br />facilitating a fraud, shall engage in conduct designed to corrupt <br />the outcome of: <br /> (1) The subject of a bet; <br /> (2) A contest of knowledge, skill, speed, strength or endurance; <br /> (3) A scheme of game of chance. <br /> <br />(b) Whoever violates this section is guilty of cheating, a <br />misdemeanor of the first degree, if the potential gain from <br />cheating is less than one hundred fifth dollars ($150.00), or <br /> <br /> <br />
