04-83 Amend General Offenses Code to Comply w/ State

Section 4. That Section 545.05 of the General Offenses Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 545.05 PETTY THEFT. (a) No person, with purpose to deprive the owner of property or services, shall knowingly obtain or exert control over either the property or services in any of the following ways: (1) Without the consent of the owner or person authorized to give consent; (2) Beyond the scope of the express or implied consent of the owner or person authorized to give consent; (3) By deception; (4) By threat. (b) Whoever violates this section is guilty of petty theft a misdemeanor of the first degree, if the value of the property is less than one hundred fifty dolllars ($150.00) if the property is not listed in Section 545.03 and if the offender has not previously been convicted of a theft offense. shall be and the same is hereby amended to read as follows: 545.05 PETTY THEFT. (b) Whoever violates this section is guilty of petty theft, a misdemeanor of the first degree, if the value of the property of services stolen is less than three hundred dollars ($300.00) if the property is not listed in Sectin 545.03 and if the of- fender has not previously been convicted of theft offense. 2913.02) (ORC Section 5. That Section 545.09 of the General Offenses Codified Ordinances of the City of Lakewood, now reading as follows: 545.09 PASSING BAD CHECKS. Code of the (a) No person, with purpose to defraud, shall issue or transfer or cause ot be issued or transferred a check or other negotiable instrument, knowing that it will be dishonored. (b) For purposes of this section, a person who issues or transfers a check or negotiable instrument i presumed to know that it will be dishonored, if either of the following occurs: (1) The drawer had no account with the drawee at the time of issue or the stated date, whichever is later.
