Section 4. That Section 545.05 of the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br />545.05 PETTY THEFT. <br /> <br />(a) No person, with purpose to deprive the owner of property <br />or services, shall knowingly obtain or exert control over either <br />the property or services in any of the following ways: <br /> (1) Without the consent of the owner or person authorized <br /> to give consent; <br /> (2) Beyond the scope of the express or implied consent of <br /> the owner or person authorized to give consent; <br /> (3) By deception; <br /> (4) By threat. <br /> <br />(b) Whoever violates this section is guilty of petty theft <br /> a misdemeanor of the first degree, if the value of the <br /> property is less than one hundred fifty dolllars ($150.00) <br /> if the property is not listed in Section 545.03 and if <br />the offender has not previously been convicted of a theft <br />offense. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />545.05 PETTY THEFT. <br /> <br />(a) No person, with purpose to deprive the owner of property <br />or services, shall knowingly obtain or exert control over either <br />the property or services in any of the following ways; <br /> <br />(1) Without the consent of the owner or person authorized <br /> to give consent; <br />(2) Beyond the scope of the express or implied consent or <br /> of the owner or person authorized to give consent; <br />(3) By deception; <br />(4) By threat. <br /> <br />(b) Whoever violates this section is guilty of petty theft, a <br />misdemeanor of the first degree, if the value of the property <br />of services stolen is less than three hundred dollars ($300.00) <br />if the property is not listed in Sectin 545.03 and if the of- <br />fender has not previously been convicted of theft offense. <br />2913.02) <br /> <br />(ORC <br /> <br /> Section 5. That Section 545.09 of the General Offenses <br />Codified Ordinances of the City of Lakewood, now reading as follows: <br /> <br /> 545.09 PASSING BAD CHECKS. <br /> <br />Code of the <br /> <br />(a) No person, with purpose to defraud, shall issue or <br />transfer or cause ot be issued or transferred a check or other <br />negotiable instrument, knowing that it will be dishonored. <br /> <br />(b) For purposes of this section, a person who issues or <br />transfers a check or negotiable instrument i presumed to know <br />that it will be dishonored, if either of the following occurs: <br /> <br />(1) The drawer had no account with the drawee at the time <br /> of issue or the stated date, whichever is later. <br /> <br /> <br />
