ORDINANCE NO. 6-83 <br /> <br />BY: Brown, Chinnock, Gallagher, Graham, <br /> McBride, Salmon, Wendlinq <br /> <br /> AN EMERGENCY ORDINANCE levying special assessments for the re- <br />pair of certain sidewalks in the City. <br /> <br /> WHEREAS, this Council, by two-thirds (2/3) vote of the members <br />elected thereto, determines that this ordinance is an emergency measure <br />which is necessary for the immediate preservation of the public peace, <br />property, health and safety and for the further reason that the assess- <br />ments herein provided for must be promptly levied in order to eliminate <br />additional expense to the City; <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />Lakewood, Cuyahoga County, State of Ohio: <br /> <br /> Section 1. That the assessment of the cost and expense of re- <br />pairing sidewalks located at the locations listed in Exhibit A attached <br />hereto in accordance with Resolution No. 477] , in the City of Lakewood, <br />Ohio, amounting in the aggregate to $ ]3,-~.--~-, notice of the filing of <br />which assessment has been given as required by law, be and the same is <br />hereby adopted and confirmed, and that there be and are hereby levied and <br />assessed upon the lots and lands bounding and abutting upon said improve- <br />ment the several amounts reported as aforesaid, which assessments and the <br />description of said lots and lands are now on file in the office of the <br />Clerk of this Council and which assessments are not in excess of the <br />special benefits and are not in excess of any statutory limitation. <br /> <br /> Section 2. That the total assessment against each lot or parcel <br />of land shall be payable in cash within thirty (30) days from and after <br />the passage of this ordinance, or, at the option of the owner, in one <br />( ] ) annual installments with interest at the rate of nine <br />per centum ( 9 %) per annum. Ail cash payments shall be made to the <br />Director of Finance of the City. All assessments and installments thereof <br />remaining unpaid at the expiration of said thirty (30) days shall be <br />certified by the Clerk of this Council to the County Auditor as provided <br />by law to be placed by him on the tax duplicate and collected as other <br />taxes are collected. <br /> <br /> Section 3. That it is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that all <br />such deliberations of this Council and of any of its committees that re- <br />sulted in such formal action were in meetings open to the public in com- <br />pliance with all legal requirements, including Section 121.22 of the Ohio <br />Revised Code. <br /> <br /> Section 4. This ordinance, having been determined to be an <br />emergency measure, shall be in full force and effect from and immediately <br />after its adoption and approval by the Mayor. <br /> <br />Adopted: ~~ ?, 1983 <br /> <br /> <br />
