ORDINANCE NO. 6-83 BY: Brown, Chinnock, Gallagher, Graham, McBride, Salmon, Wendlinq AN EMERGENCY ORDINANCE levying special assessments for the re- pair of certain sidewalks in the City. WHEREAS, this Council, by two-thirds (2/3) vote of the members elected thereto, determines that this ordinance is an emergency measure which is necessary for the immediate preservation of the public peace, property, health and safety and for the further reason that the assess- ments herein provided for must be promptly levied in order to eliminate additional expense to the City; NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Lakewood, Cuyahoga County, State of Ohio: Section 1. That the assessment of the cost and expense of re- pairing sidewalks located at the locations listed in Exhibit A attached hereto in accordance with Resolution No. 477] , in the City of Lakewood, Ohio, amounting in the aggregate to $ ]3,-~.--~-, notice of the filing of which assessment has been given as required by law, be and the same is hereby adopted and confirmed, and that there be and are hereby levied and assessed upon the lots and lands bounding and abutting upon said improve- ment the several amounts reported as aforesaid, which assessments and the description of said lots and lands are now on file in the office of the Clerk of this Council and which assessments are not in excess of the special benefits and are not in excess of any statutory limitation. Section 2. That the total assessment against each lot or parcel of land shall be payable in cash within thirty (30) days from and after the passage of this ordinance, or, at the option of the owner, in one ( ] ) annual installments with interest at the rate of nine per centum ( 9 %) per annum. Ail cash payments shall be made to the Director of Finance of the City. All assessments and installments thereof remaining unpaid at the expiration of said thirty (30) days shall be certified by the Clerk of this Council to the County Auditor as provided by law to be placed by him on the tax duplicate and collected as other taxes are collected. Section 3. That it is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that re- sulted in such formal action were in meetings open to the public in com- pliance with all legal requirements, including Section 121.22 of the Ohio Revised Code. Section 4. This ordinance, having been determined to be an emergency measure, shall be in full force and effect from and immediately after its adoption and approval by the Mayor. Adopted: ~~ ?, 1983
